Hwy 12 <br />Victor CA 95253 <br />Dear Mr. Lawson <br />On July 7, 2017 an in office review was conducted for the California Accidental Release <br />Prevention Program (Cal -ARP), and a compliance review report, citing violations, was issued. <br />On December 7, 2017, the following programs were inspected through a site visit, the Cal - <br />ARP and the Hazardous Materials Business Plan, at 8751 E. Hwy 12, Victor CA 95253 <br />(hereinafter "Facility") and reports of violations were issued. <br />The inspections were performed by representatives of the San Joaquin County Environmental <br />Health Department ("EHD"), which is the certified unified program agency ("CUPA") in this <br />jurisdiction. <br />During the inspection, EHD discovered violations of law and, based on those findings, EHD is <br />prepared to bring an administrative action against you pursuant to California Health and <br />Safety Code Section 25404.1.1. The administrative action is to ensure compliance with <br />applicable statutes and assess penalties for violations. A copy of the inspection report and a <br />non-compliance letter identifying outstanding violations, are enclosed. <br />EHD has found that the Facility is/was in violation of the following regulations: <br />1. CCR 2735.5(a) Failed to coordinate implementation requirements with the EHD <br />2. CCR 2745.2(b)(1) Failed to submit a corrected, revised Risk Management Plan (RMP) to <br />the EHD within 60 calendar days <br />3. CCR 2785.1(b) Failed to request assistance from the EHD when necessary to address <br />compliance or safety issues <br />1868 E.
