(defined as clean, chipped material derived from the construction and demolition <br /> materials, pallets, crates, boxes and tree trimmings). The fuel does not contain pressure <br /> treated wood and does not contain compounds listed in Title 22 CCR Section <br /> 66261.24(a)(2)(A) in amounts exceeding the Total Threshold Limit Concentration (TTLC) <br /> values. Biomass fuel also includes agricultural residues (defined as organic plant-based <br /> material generated by agricultural operations) including, but not limited to: grasses, reject <br /> seed, corn cobs; orchard and vineyard pruning's (orchard removals); prune, peach and <br /> olive pits; coffee and cocoa beans; almond shells and hulls; walnut shells; and rice hulls. <br /> Biomass Combustion Process: A combustion process which has a primary energy <br /> source of biomass or biomass waste, and of which 75 percent of the total energy input is <br /> from those sources during any calendar year, and of which 25 percent or less of the other <br /> energy sources do not include sewage sludge, industrial sludge, medical waste, <br /> hazardous waste, radioactive waste, or municipal solid waste2. <br /> Disposal: Disposal is the final deposition of nonhazardous ash onto land; stockpiling of <br /> nonhazardous ash onto land for a combined period of time greater than six months when <br /> located for use at the site of a transfer/processing operation(s) unless the Regional Water <br /> Quality Control Board (RWQCB) in consultation with the enforcement agency authorizes <br /> nonhazardous ash to remain within the operations area for a period of time greater than <br /> six months. Disposal does not include the use of nonhazardous ash for cover material <br /> at a solid waste landfill; the use of nonhazardous ash for a reclamation project; use of <br /> nonhazardous ash for snow and ice control, road-base/sub-base, walk areas, parking <br /> areas, airport runways, trails, dairy or feedlot soil stabilization, structural fill, <br /> sludge/manure/waste stabilizing material, compost mineral filler, smelter flux, blending in <br /> a soil product, and similar uses in accordance with the California Public Resources Code <br /> Section 401803. <br /> Generator: The nonhazardous ash producer. <br /> Hazardous Material: Any material that, because of its quantity, concentration, physical <br /> or chemical characteristics, poses a significant present or potential hazard to human <br /> health and safety or to the environment if released into the workplace or the environment. <br /> Hazardous materials include, but are not limited to, hazardous substances, hazardous <br /> waste, and any material that a handler or the administering agency has a reasonable <br /> basis for believing that it would be injurious to the health and safety of persons or harmful <br /> to the environment if released into the workplace or the environment. <br /> Hazardous Waste: Waste as defined in Title 22 CCR Section 66261.3.
