Copies of hazardous waste disposal records for used oil and oil filters for the forklift was not found on site. The manager stated that someone comes to work on the forklift and takes the waste back with him. The manager did not know who did the work on the forklifts or what he does with the waste. If the used oil is being taken with the service company,the following documentation needs to be kept for the facility to show that the repair business is following California Health and Safety Code Section 25250.12 under Article 13 of Management of Used Oil: -The amount of used oil generated showing that no more than 55 gallons is transferred in the vehicle at any one time. -The name and address of where used oil is being transported to. -The date the used oil is generated. Used oil filters need to be managed according to hazardous waste laws and regulations. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately start keeping the correct records. This is a minor violation. 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. Bills of lading or manifests for the management of lead acid batteries for the last three years were not found on site. A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the EHD. This is a repeat violation, Class II. 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on September 4,2018 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by October 3, 2018. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination equipment. Used oil was observed in the used oil secondary containment and used antifreeze was observed in the used antifreeze secondary containment. All facility communications or alarm systems,fire protection equipment, spill control equipment, and decontamination equipment,where required, shall be tested and maintained as necessary to assure its proper operation in time of emergency. Immediately drain the secondary containment and begin this practice. This is a repeat violation, Class II.
