The <br /> manager stated that someone comes to work on the forklift and takes the waste back with him. The manager did <br /> not know who did the work on the forklifts or what he does with the waste. <br /> If the used oil is being taken with the service company,the following documentation needs to be kept for the facility <br /> to show that the repair business is following California Health and Safety Code Section 25250.12 under Article 13 of <br /> Management of Used Oil: <br /> -The amount of used oil generated showing that no more than 55 gallons is transferred in the vehicle at any one <br /> time. <br /> -The name and address of where used oil is being transported to. <br /> -The date the used oil is generated. <br /> Used oil filters need to be managed according to hazardous waste laws and regulations. <br /> Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts <br /> used in a consolidated manifesting procedure on site for three years and have them readily available for review. <br /> Immediately start keeping the correct records. <br /> This is a minor violation. <br /> 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br /> Bills of lading or manifests for the management of lead acid batteries for the last three years were not found on site. <br /> A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of <br /> lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the <br /> EHD. <br /> This is a repeat violation, Class II. <br /> 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on September 4,2018 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted by October 3, 2018. <br /> This information has not been received resulting in a non-compliant status for this facility. An operator that receives <br /> an inspection report shall have 30 days to submit a written response that includes a statement documenting <br /> corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response <br /> documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. <br /> This is a Class II violation. <br /> 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br /> equipment. <br /> Used oil was observed in the used oil secondary containment and used antifreeze was observed in the used <br /> antifreeze secondary containment. <br /> All facility communications or alarm systems,fire protection equipment, spill control equipment, and <br /> decontamination equipment,where required, shall be tested and maintained as necessary to assure its proper <br /> operation in time of emergency.
