S A N sJ O A Q U I N Environmental Health Department
- COUNTY --
Small Quantity Hazardous Waste Generator Inspection Report
Facility Name: Facility Address: Date:
Marshalls 0122 2203 GRAND CANAL BLVD, STOCKTON August 06, 2020
SUMMARY OF VIOLATIONS
(CLASS I,CLASS ll,or MINOR-Notice to Comply)
Item# Remarks
102 CCR 66262.11 Failed to determine if a waste is a hazardous waste.
OBSERVATIONS:
When asked how spills of a hazardous chemical are cleaned up and managed, Stephanie Ella, an assistant store
manager, stated Magic Monkey(absorbent)is applied to the spill, picked up, and then placed into the trash. At the
time of inspection,a leaking container of Goo Gone adhesive remover, observed inside a Corrosive Bases
Hazardous Waste container, leaked onto the floor next to the hazardous waste storage area. Stephanie applied
absorbent to the spill and then placed the used absorbent into a nearby trash can. Several damaged and empty, or
partially empty, containers of hazardous chemicals were observed inside of the hazardous waste storage containers
without used absorbent, further indicating that the missing hazardous chemicals may have been disposed of into the
trash.
REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste
as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous
wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive
or ignitable.
CORRECTIVE ACTION: Immediately stop disposing of absorbent used to clean-up hazardous chemical spills into
the trash, make a hazardous waste determination for each waste, and manage it according to Title 22 CCR. Use
Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste
determination. Waste testing must be done using methods specified in Title 22 CCR including sections
66261.20-24.
Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current
storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes
determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your
hazardous waste generator status.
This is a minor violation.
104 CCR 66262.34(d)(2) No modified contingency plan.
OBSERVATION: A complete modified contingency plan was not posted at the facility.
REGULATION GUIDANCE: The business operator must post the following information next to telephones or in
areas directly involved in the generation and accumulation of hazardous waste: the name and emergency
telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the
telephone number of the fire department unless the facility has a direct alarm.
CORRECTIVE ACTION: Immediately post the required information at the facility. Provide a statement to the San
Joaquin County Environmental Health Department that the correction is complete.
This is a minor violation.
FA0006560 PR0539289 SCO01 08/06/2020
EHD 22-01 Rev.9/20/2019 Page 4 of 9 Small Quantity Hazardous Waste Generator OIR
1868 E.
