Employees were unable to identify which waste streams were hazardous waste <br /> at their facility which resulted in either the illegal disposal of a hazardous waste or illegal treatment of a hazardous <br /> waste, ECH7080 and EC700. Victor informed me all paints used are water based and are not hazardous waste even <br /> though they waste from cleaning the gun with water is being disposed of as a hazardous waste. The generator must <br /> ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and <br /> emergency procedures. Immediately provide training to all employees who handle hazardous waste and submit a copy <br /> of the training records to the EHD. Class II violation. <br /> 202 NSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. <br /> -Envirobase High Performance ECH7080, flashpoint 104 F and EC700, flashpoint 76 F with pourable amounts were <br /> found in the trash can in the mixing room. According to an employee onsite, the cans are allowed to air dry in the trash <br /> can. <br /> -Bondo waste analysis submitted to this office June 10, 2013 had selenium levels at 1.903mg/L and zinc levels at 581 <br /> mg/L. On September 11, 2013 an email was received by this office with an indication a new product was being <br /> sampled to potentially replace the bondo product, that according to the analysis submitted,was a hazardous waste <br /> when disposed of. Upon reviewing the file no further information had been received. At time of inspection on October <br /> 23, 2014 the bondo waste was in a hazardous waste drum. It is not clear which bondo product is being used and when <br /> it was first started to be handled as a hazardous waste. <br /> Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, and <br /> disposal facility (TSDF). Immediately cease disposal of hazardous waste to the trash and ensure that all future waste <br /> is hauled by a licensed hazardous waste transporter to a permitted TSDF. Class I violation. <br /> 204 HSC 25201(a) Failed to obtain a permit to treat hazardous waste. <br /> Envirobase High Performance ECH7080, flashpoint 104 F and EC700, flashpoint 76 F with pourable amounts were <br /> found in the trash can in the mixing room. According to an employee onsite, the cans are allowed to air dry in the trash <br /> can. This facility does not have a hazardous waste treatment permit issued from either the EHD or the DTSC. <br /> Immediately cease treatment of hazardous waste without a permit or obtain a treatment permit. Class I violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> A 55g drum of water based waste paint was seen open. All hazardous waste containers shall be closed at all times <br /> except when adding or removing waste. Immediately close these containers and ensure all hazardous waste <br /> containers are closed when not adding or removing waste. Class II violation. <br /> 601 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. <br /> 1-55g drum of water based paint waste had what appeared to be a start date of 9/2/2013, 1-55g drum of solvent paint <br /> waste had an illegible label, and a 55g drum of bondo dust did not have a start accumulation date. Facilities who <br /> generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any <br /> time may store waste on site up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this <br /> waste under manifest and submit a copy of the manifest to the EHD.
