This is a <br /> repeat violation, Class H. t <br /> Response to Item No. 102: <br /> In an abundance of caution,Cooks Collision manages all waste paint generated at the <br /> facility as hazardous waste. All pourable amounts of paint are either collected for use in <br /> operations;or,if the paint cannot be used in operations,the paint is collected in <br /> accumulation bins for disposal by Cooks Collision's hazardous waste hauler. Cooks <br /> Collision has trained all employees on the proper management of hazardous materials and <br /> hazardous waste. Please see response to Item No. 105 for more information on Cooks <br /> Collision's training. <br /> Cooks Collision has contracted with a licensed hazardous waste disposal company, <br /> Safety-Kleen Systems,Inc.,to ensure proper disposal of hazardous waste accumulated at <br /> the facility. Cooks Collision has material safety data sheets for all hazardous materials i <br /> used at the facility,waste manifests and waste determinations for all hazardous waste <br /> removed by its hazardous waste disposal vendor. Copies of the December 11, 2014,and <br /> December 24, 2014,Uniform Waste Manifests and associated waste determinations for <br /> waste paint removed from the facility are enclosed as Attachment B. <br /> Supplemental Response to Item No. 102: E_ <br /> All "leftover paint"in spray guns is collected for use in operations. If paint cannot be 1 <br /> collected and used in operations,the paint is waste paint and is collected in waste drums <br /> for disposal as hazardous waste. Manifests for waste paint are attached hereto as <br /> Attachments S-1 and S-2. At no time has Cooks Collision disposed of"leftover paint" <br /> in the municipal trash, as Cooks Collision has characterized waste paint as hazardous <br /> waste. Waste paint is transported by a waste hauler to a permitted hazardous waste <br /> treatment,storage, and disposal facility ("TSDF"). <br /> Cooks Collision does not dispose of paint cups within the municipal trash. Paint cups <br /> with a usable amount of paint are used throughout the day during operations. When paint <br /> cups are unable to be used in operations,they are emptied and placed into a closed <br /> container and are collected by Corrick Enviro Services,Inc. Please see the respective <br /> bills of lading attached hereto as Attachment 8-3. <br /> Empty paint cans have been characterized as hazardous waste and are not disposed in the <br /> municipal trash. Empty solvent cans are placed in closed containers and are collected <br /> and transported to a TSDF. Manifests for paint cans are attached hereto as Attachment <br /> S-4. <br /> Item No. 103: CCR 66262.34(d)(2). No Modified Contingency Plan. An emergency <br /> coordinator and modified contingency plan information is lacking.
