5. The hazardous waste from this store is transported to disposal facilities located in <br />Inglewood, CA, 340 miles from the store; Fernly, NV, 216 miles from the store; and <br />Yuma, AZ, 610 miles from the store. Transport to each of these receiving facilities <br />exceed the 200 mile threshold, allowing 270 days of on-site accumulation. <br />6. The meal replacement products identified in the amended inspection report on page 4, <br />item 102, display Nutri-facts labels and are considered food – not hazardous waste <br />(EXHIBIT D). The meal replacement product found in the tote was mistakenly classified <br />as waste, but was left in the tote for disposal. <br />The Suavitel fabric softener cited in the same section was processed as hazardous waste <br />and added to the appropriate tote. This waste was picked up by Stericycle on June 5, 2019 <br />(EXHIBIT E). <br />7. The products identified in the amended inspection report on page 9, item 202, were <br />processed as hazardous waste and added to the appropriate totes along with the pertinent <br />cleanup material. This waste was picked up by Stericycle on June 5, 2019 <br />(EXHIBIT E). <br />8. Each waste tote at the accumulation station was examined for damage, leakers, and ill- <br />fitting tops. Totes were also cleaned inside and outside as necessary. Product that had <br />been identified as hazardous waste that was retrieved from other areas of the store was <br />properly processed and placed in closed containers (EXHIBIT F). The management team <br />was coached that hazardous waste is to be taken to the waste station immediately and <br />processed, not be allowed to accumulate in other areas. <br />9. After the June 5, 2019 waste pickup, complete and correct tote labels were applied to the <br />empty hazardous waste totes (EXHIBIT G). <br />10. The recalled product – Prevacid and Ibuprofen – was removed from the manager’s office <br />and processed as hazardous waste (EXHIBIT H). <br />11. The weekly inspections have resumed (EXHIBIT I). <br />The signed certification is also included.
