Board of Housing Appeals Mec g <br /> Staff Report — 10900 E. Tokay Colony Rd., Lodi <br /> III. Case Summary <br /> a. Initial Posting: <br /> On January 10, 2007, one (1) single family dwelling and one (1) barn were <br /> determined to have been contaminated by methamphetamine laboratory <br /> activities in accordance with California Health and Safety Code, Section <br /> 25400.20. <br /> On January 10, 2007, violations of the California Health and Safety Code, <br /> Section 17920.3, were observed, and one (1) single family dwelling and one (1) <br /> barn were posted as substandard structures. <br /> Violations observed in the single family dwelling on the date of posting include: <br /> 1 . Any nuisance (Health and Safety Code, Section 17920.3(c)). <br /> 2. Fire Hazard (Health and Safety Code, Section 17920.3(h)). <br /> 3. Improper occupancy (Health and Safety Code, Section 17920.3(n)). <br /> Violations observed in the barn on the date of posting include: <br /> 4. Any nuisance (Health and Safety Code, Section 17920.3(c)). <br /> 5. Fire Hazard (Health and Safety Code, Section 17920.3(h)). <br /> 6. Improper occupancy (Health and Safety Code, Section 17920.3(n)). <br /> The violations observed were of such a nature that the single family dwelling <br /> and the barn were determined to be unsafe to occupy. The single family <br /> dwelling and the barn were posted unsafe to occupy pursuant to the California <br /> Health and Safety Code, Section 25400.18, and the Uniform Code for the <br /> Abatement of Dangerous Buildings, Section 404(b). <br /> b. Compliance Status Summary: <br /> • On January 30, 2009, the EHD faxed a list of methamphetamine <br /> activity items seized on property to consultant, Bovee Environmental <br /> Management, Inc. (BEM). <br /> • On February 4, 2009, a check for permits in the San Joaquin County <br /> Community Development Department's (CDD) database found that a <br /> permit to change windows had been obtained on January 21, 2009 and <br /> was finaled on January 29, 2009. <br /> • On March 6, 2009, the EHD received a Preliminary Site Assessment <br /> Work Plan (PSA-WP) from the consulting firm BEM. The work plan was <br /> found to be insufficient and a letter requesting additional information <br /> was mailed to the property owner, with a copy to BEM. <br /> • On March 12, 2009, the EHD was notified by the consulting firm BEM <br /> that they were no longer authorized to be working on the case. <br /> • On March 20, 2009, the EHD received a revised draft PSA-WP from <br /> BEM. <br /> • On March 26, 2009, the EHD received the final copy of the PSA-WP <br /> from BEM. <br /> PR0527067 Page 2 of 4 <br />
