There was approximately 194 cubic yards of in-process compost in the <br /> bunker house at the time of the inspection. <br /> 5. The site manager stated that 120,000 chicken carcasses were ground up and <br /> mixed with wood shavings and placed in compost windrows in the bunker <br /> house. <br /> VIOLATIONS: <br /> Based on the facts set forth in the findings 1-5, the LEA has determined that you are <br /> in violation of operating a solid waste facility without a Compostable Materials <br /> Handling Facility Permit (CMHFP). <br /> 1. PRC, Section 44002 which states; "No person shall operate a solid waste <br /> facility without a solid waste facilities permit if that facility is required <br /> to have a permit pursuant to this division (Division 30: Waste <br /> Management)". <br /> 2. CCR Title 14, Section 17854, which states; "Except as specified in this <br /> Article, all compostable materials handling activities shall obtain a <br /> Compostable Materials Handling Facility Permit pursuant to the <br /> requirements of Title 27, California Code of Regulations, Division 2, <br /> Subdivision 1, Chapter 4, Subchapter 1 and Subchapter 3,Articles 1, 2, <br /> 3 and 3.1 (commencing with section 21450) prior to commencing <br /> operations." <br /> TAKE FURTHER NOTICE THAT: <br /> ORDER: <br /> It is hereby ordered that, pursuant to the California Public Resources Code and the <br /> California Code of Regulations, Mr. Wen Chang Su, as the owner and operator of SKS <br /> Enterprises Inc. at 24299 E Brandt Road, Lodi, California, APN 02318001, is required to <br /> comply with the following: <br /> 1. Pursuant to PRC, Section 45005, immediately cease and desist composting <br /> chicken carcasses at the facility. <br /> 2. Pursuant to CCR Title 14, Section 18304 (d)(2): Notices and Orders, submit <br /> a corrective action plan to the LEA within five (5) calendar days upon <br /> receipt of this Notice.
