Page 3 of 4 <br /> PENALTIES: <br /> Failure to comply with the Order to Cease and Desist operating a compost facility <br /> without a Compostable Materials Handling Facility Permit (CMHFP) will result in the <br /> issuance of a Notice and Order that will allow for the imposition of an administrative <br /> civil penalties not to exceed ten thousand dollars ($10,000) for each day the violation <br /> occurs pursuant to PRC, Section 45023 <br /> Failure to comply with the order to submit a Corrective Action Plan as specified will <br /> result in the issuance of a Notice and Order that-will establish a mandated time schedule <br /> according to which the facility shall be brought into compliance and will allow for the <br /> imposition of an administrative civil penalty of$5,000 per day of violation, with a limit <br /> of$15,000 per calendar year pursuant to PRC, Section 45011 (a) of non-compliance with <br /> the established time schedule. <br /> Continual non-compliance may cause the LEA and the California Integrated Waste <br /> Management Board to contract for corrective action with the amount expended subject to <br /> recovery pursuant to PRC, Section 45000. <br /> Be advised that PRC, Section 45001states; "Nothing in this division (Division 30) <br /> affects the authority of the state water board or a regional board to issue <br /> enforcement orders to take corrective actions with regards to solid waste facilities." <br /> Date 7IC Z_-9 <br /> Robert McClellon, Program Coordinator, RENS <br /> Environmental Health Department <br /> Local Enforcement Agency <br /> Page 3 of 4 <br />
