1 constructive knowledge of this Injunction, only insofar as they are doing business in the State of <br /> 2 California and confined to Defendant' s INDUSTRIAL LAUNDRY PROCESSING activities in the <br /> 3 County of San Joaquin. <br /> 4 3 . Defendant, with actual or constructive knowledge of this Injunction, only in so far as <br /> 5 they are doing business in the State of California, in the course of Defendant' s INDUSTRIAL <br /> 6 LAUNDRY PROCESSING activities in San Joaquin County, are pursuant to Health and Safety Code <br /> 7 section 25181 hereby permanently enjoined from : <br /> 8 a. Failing to determine if that waste is a hazardous waste, in violation of <br /> 9 California Code of Regulations, title 22 section 66262 . 11 ; <br /> 10 b . Failing to retain copies of any test results, waste analyses, or other <br /> 11 determinations for at least three (3) years from the date the waste was last sent to on-site or off-site <br /> 12 treatment, storage, or disposal , in violation of California Code of Regulations , title 22 section <br /> 13 66262.40 (c) ; <br /> 14 c . Failing to have at all times at least one employee either on facility premises or <br /> 15 on call with the responsibility for coordinating all emergency response measures, in violation of <br /> 16 California Code of Regulations, title 22 section 66262 .34 (4) (2); <br /> 17 d . Failing to report program data for a regulated business electronically, in <br /> 18 violation of Health and Safety Code section 25404 (e) (4) ; <br /> 19 e . Failing to respond to any fire, spill of hazardous waste, or other releases which <br /> 20 could threaten human health, in violation of California Code of Regulations, title 22 section <br /> 21 66262.34(d) (2) ; <br /> 22 f. Failing to completely label or mark each container or portable tank used for <br /> 23 onsite accumulation of hazardous waste, in violation of California Code of Regulations, title 22 <br /> 24 section 66262. 34(f); <br /> 25 g . Failing to describe in the contingency plan the actions facility personnel shall <br /> 26 take in response to fires, explosions, or any unplanned sudden or non-sudden release of hazardous <br /> 27 waste constituents to air, soil , or surface water at the facility, in violation of California Code of <br /> 28 Regulations, title 22 section 66265 . 52; <br /> - 2 - <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
