I relief sought by Plaintiff for such violations or alleged violations shall be sought by noticed motion. <br /> 2 Plaintiff shall notify Defendant in writing of such alleged violations and shall meet and confer with <br /> 3 Defendant within twenty (20) business days of such written notice prior to filing any such motion. <br /> 4 The Parties shall negotiate in good faith in an effort to resolve any further penalty assessments or <br /> 5 other relief pursuant to this paragraph without judicial intervention . Defendant reserves all defenses <br /> 6 in law and equity. <br /> 7 Be If all the conditions listed in paragraph 10 above are met, then upon the expiration of <br /> 8 the PENALTY STAY PERIOD, the stayed penalty shall be suspended permanently. <br /> 9 14 . Defendant shall additionally pay to Plaintiff the sum of TWO THOUSAND <br /> 16 DOLLARS ($2,000 . 00) as partial recovery of the cost of investigation and suit incurred by the SAN <br /> 17 JOAQUIN COUNTY OFFICE OF THE DISTRICT ATTORNEY. Said payment shall be due and <br /> 18 pa abs the aforementioned agency, and shall be delivered to the San Joaquin County Office of the <br /> 19 District Attorney, Environmental Crimes Unit, at time of signing. <br /> 20 16 . Defendant is responsible for the uniform fee for filing the first paper in a civil action <br /> 21 or proceeding in the Superior Court. The amount of the filing fee is FOUR HUNDRED THIRTY- <br /> 22 FIVE DOLLARS ($435 . 00) . Said payment shall be made payable to, the SAN JOAQUIN COUNTY <br /> 23 SUPERIOR COURT and delivered to the San Joaquin County Office of the District Attorney, <br /> 24 Environmental Crimes Unit, at time of signing. <br /> 25 17. This Judgment shall go into effect immediately upon entry hereof.
