I Joaquin County; <br /> 2 b. Defendant will not violate Health and Safety Code sections 25500 et seq. , as <br /> 3 described in paragraph 4 above at its INDUSTRIAL LAUNDRY PROCESSING facilities in San <br /> 4 Joaquin County; <br /> 5 c. Defendant will not violate or engage in any of the unlawful acts of unfair <br /> 6 competition as set forth in the First and Second Causes of Action of the Complaint filed in this <br /> 7 action , as well as any other violations of the Business and Professions Code sections 17200 et seq. , <br /> 8 including but not limited to Health and Safety Code sections 25100 et seq. , and 25500 et seq, , at its <br /> 9 INDUSTRIAL LAUNDRY PROCESSING facilities in San Joaquin County, <br /> 10 11 . The PENALTY STAY PERIOD shall be three (3) years, subject to attendance at a <br /> 11 training class offered by the San Joaquin County Environmental Health Department in Hazardous <br /> 12 Materials Business P1an/CERS or Hazardous Waste Management (" CUPA TRAINING CLASS ") by <br /> 13 at least one representative of Defendant on an annual basis beginning in the 2020 calendar year for a <br /> 14 period of three (3 ) years, with recordkeeping of same. If Defendant fails to comply with this <br /> 15 Paragraph 11 , the PENALTY STAY PERIOD shall be extended up to an additional two (2) years, for <br /> 16 a maximum PENALTY STAY PERIOD of five (5 ) years, upon prior notice to Defendant of <br /> 17 noncompliance, Notwithstanding the foregoing, attendance at a CUPA TRAINING CLASS in San <br /> 18 Joaquin County shall be required only where such training exists and is open to the regulated <br /> 19 community; if a CUPA TRAINING CLASS ceases to exist or is otherwise unavailable to the <br /> 20 regulated community within the three year period and Defendant has otherwise complied with this <br /> 21 Paragraph 11 , the PENALTY STAY PERIOD shall not be extended. <br /> 22 12 . The TWENTY THOUSAND DOLLARS ($20,000 . 00) in civil penalties, described in <br /> 23 paragraph 10 above, shall immediately be due and payable as set forth in paragraph 10 above, if the <br /> 24 San Joaquin County Office of the District Attorney files Declarations that Defendant violated Health <br /> 25 and Safety code sections 25100 et seq. , or Health and Safety Code sections 25500 et seq. or Business <br /> 26 and Professions Code sections 17200 et seq. , as described in paragraphs 3 , 4, and 5 above at <br /> 27 Defendant' s INDUSTRIAL LAUNDRY PROCESSING facilities in San Joaquin County for <br /> 28 allegations arising prior to the expiration of the PENALTY STAY PERIOD . Any penalties or other <br /> - 7 - <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
