Please read this Order carefully. <br /> The Central Valley Water Board (Regional Board) is a state agency that is charged with <br /> protecting the quality of California's surface water and groundwater. One of the Regional <br /> Board's responsibilities is to adopt waste discharge requirements (WDRs) pursuant to the <br /> California Water Code for those entities which discharge waste to land. The Regional Board is <br /> issuing this Notice of Violation and California Water Code Section 13260 Order for Technical <br /> Reports to the City of San Francisco Public Utilities Commission (hereafter SFPUC or <br /> Discharger) due to California Water Code Violations reported at the Discharger's Tesla Water <br /> Treatment Facility in Vernalis. <br /> On 21 March 2018, Regional Board staff was notified by the San Joaquin County Environmental <br /> Health Department that the Discharger's facility, located at 9000 West Vernalis Road was <br /> discharging waste associated with the ultraviolet water treatment system to an unlined <br /> sedimentation basin adjacent to the facility. The waste periodically contains incidental <br /> discharges of mercury. The discharge of mercury, at a minimum, would qualify as a designated <br /> waste under section 13173 (b) of the California Water Code. <br /> On 19 June 2018, Regional Board staff received notification again from the County that two <br /> additional unauthorized discharges containing mercury occurred on 10 and 15 June 2018. <br /> Board staff understands that the County has requested that the SFPUC collect soil samples <br /> from the unlined sedimentation basin to evaluate mercury concentrations and cleanup options. <br /> Based on the information provided by County staff, there have been six reported discharges of <br /> waste containing mercury since September 2016. <br /> SFPUC has and continues to violate section 13260 of the California Water Code (CWC) for the <br /> discharge waste without WDRs. As discussed on 19 June 2018 with SFPUC regulatory <br /> compliance staff, the discharge of waste from the facility must cease until the Central Valley <br /> Water Board has issued Waste Discharge Requirements for such a discharge. <br /> KARL E.
