Clothing security tags containing red ink and clothing security tags containing blue and yellow ink were observed <br /> in containers to be re-used by the facility.According to Robert Leal,the assistant store manager, <br /> damaged/un-usable security tags containing ink are disposed of into the trash.At the time of inspection a security <br /> tag containing blue and yellow ink was found attached to a glove inside the facility's dumpster. Robert Leal removed <br /> the glove and the security tag from the dumpster at the time of inspection and directed an employee to remove the <br /> security tag from the glove. <br /> 2.An All-Star Tiger Stick batting grip was found leaking into the item's own packaging, inside the Defectives storage <br /> container.According to Robert, defective items are sent to the facility's distribution center, located in Goodyear, <br /> Arizona. Robert indicated that the leaking batting grip could be managed as hazardous waste. Robert stated he <br /> would have to go into the facility's WERC computer system to determine which hazardous waste container the <br /> batting grip should be placed.At the time of inspection Robert was unable to login to the WERC system. During <br /> review of the inspection report, Robert logged into the WERC system,typed in the batting grip's UPC <br /> (029343541605), and no information or Safety Data Sheets came up for the batting grip. Robert went to the <br /> Tigerstick.com,which states for the batting grip, "'This product is not considered to be or to contain hazardous <br /> chemicals based on evaluation made by our company under the OSHA Hazard Communication Standard, 29 CFR <br /> 1910.1200.'No SDS Sheet is required..."This violation issue was corrected on the date of inspection. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop disposing of security tags containing ink into the trash, stop sending <br /> waste/defective items that are potentially hazardous to the facility's distribution center, make a hazardous waste <br /> determination for each waste, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste <br /> sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must <br /> be done using methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
