Owner stated he believed he was exempt from the requirement to obtain an <br /> EPA ID since he generates less than 100kg of hazardous waste per month. However, California regulations do not <br /> have an equivalent small quantity generator exemption. This business does not meet exemption conditions for <br /> obtaining an ID number. See California Code of Regulations title 22,section 66262.12. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat,store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID)Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain a State ID number. Immediately apply for your ID number and submit evidence to the San Joaquin <br /> County Environmental Health Department within 30 days. <br /> This is a minor violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The 55 gallon drum of used oil was observed with an open drum funnel attached to the bung hole. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close the 55 gallon used oil container and ensure all hazardous waste <br /> containers are closed when not adding or removing waste.
