As set forth above, all information gathered during the study by Kleinfelder is considered confidential and will be released only upon written authorization from the client or as required by law. California law requires a person to inform the state if a situation is encountered that can be considered an immediate endangerment to the public's health or welfare and/or to the environment. Therefore, the client shall be contractually bound to make said disclosures in lieu of Kleinfelder, its owners, principals, employees, or subcontractors. Pertinent information obtained during the environmental assessment will be verbally reported prior to issuance of the report of findings. If additional investigation efforts or sampling and analysis are recommended based upon our research, a separate scope of work, schedule, and budget will be submitted for your approval prior to completion of this study. CLIENT RESPONSIBILITIES AND ASSUMPTIONS This Work Plan is based on the following assumptions: • Adequate workspace and access will be provided by the client and or owners. • Kleinfelder is not responsible for the site safety of others. • Soil and/or water generated during the field assessment will be the responsibility of the client and/or property owner. Soil and water generated will be contained and left on site. • Push probe and drilling techniques are being proposed for this scope of work. The Client should be aware that push probe techniques may be limited in its ability to penetrate hard soil, compacted soil, lime treated soil, etc., and additional means of investigation may be warranted depending upon actual Site conditions. Difficult probing conditions are likely to incur either additional costs or necessitate a reduced scope of work within the estimated time. • The client should be aware that penetrating the site's surface is inherently risky. It is impossible to determine with certainty the precise location of all structures (such as irrigation lines, septic system tanks or leach fields) which may be buried in the ground. Kleinfelder's fee is not adequate to compensate for both the performance of the services and the assumption of risk of damage to such structures.
