In determining whether a violation is chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action ) . On 10/25/2019 , Stacy Rivera of the San Joaquin County Environmental Health Department ( EHD ) performed a routine undergroun storage tank inspection at the above referenced site. The site was found to be out of compliance . The violations include but are no limited to the following : -According to Manish Pahwa , Mr Karan Pahwa has been the new owner at the above facility since 3/20/2019. A permit to operate th UST system has not been issued . No person may own or operate an UST unless a permit for its operation has been issued by the loca agency to the owner or operator of the UST system . ( HSC 25284) -Any person assuming ownership of an UST used for the storage of hazardous substance for which a valid operating permit has bee issued shall have 30 days from the date of assumption of ownership to the owner or operator of the tank. ( HSC 25284) -No CERS submittal has been made for the new owner. Permits may be transferred to a new underground storage tank owner if Cc complete submittal is made to the California Environmental Reporting System within 30 days of the change in ownership . (CCR 2712) -The mechanical flapper used as the overfill prevention system on the diesel UST was listed as a failure on the 1 /11 /19 overfil prevention equipment inspection and is not currently functional . All UST systems must be equipped with an approved , functional overfill prevention device at all times during delivery operations . (CCR 2635) The site must be brought into compliance to avoid the entire UST system being red tagged 7-days from the receipt of this Notice.
