In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> On 10/25/2019, Stacy Rivera of the San Joaquin County Environmental Health Department (EHD) performed a routine underground <br /> storage tank inspection at the above referenced site. The site was found to be out of compliance. The violations include but are no <br /> limited to the following: <br /> -An incomplete CERS submittal has been made for the new owner. Permits may be transferred to a new underground storage tan <br /> owner if a complete submittal is made to the California Environmental Reporting System within 30 days of the change in ownership. <br /> (CCR 2712) <br /> -The mechanical flapper used as the overfill prevention system on the diesel UST was listed as a failure on the 1/11/19 overfil <br /> prevention equipment inspection and is not currently functional. All UST systems must be equipped with an approved,functional overfil <br /> prevention device at all times during delivery operations.
