I the County of San Joaquin and elsewhere in the State of California. <br /> 2 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they <br /> 3 are doing business in the State of California, in the course of Defendant's PROPERTY AND <br /> 4 GASOLINE TANK OWNER activities, are pursuant to Health and Safety Code section 25299.01 are <br /> 5 pennanently enjoined from: <br /> 6 a. Failing to retain a copy of the permit and all conditions and attachments, including <br /> 7 monitoring plan at the facility, in violation of California Code of Regulations,title 23 section <br /> 8 2712(i); <br /> 9 b. Failing to file Underground Storage Tank Operating Permit Application—Facility <br /> 10 Information and Underground Storage Tank Monitoring Plan with the local government agency, in <br /> 11 violation of California Code of Regulations, title 23 section 2711(c); <br /> 12 c. Failing to design and construct an underground storage tank system with a <br /> 13 monitoring system capable of detecting the entry of hazardous substance stored in the primary <br /> 14 containment into the secondary containment, in violation Health and Safety Code section 25291(b); <br /> 15 d. Failing to maintain evidence of financial responsibility, in violation of Health and <br /> 16 Safety Code section 25292.2; <br /> 17 e. Failing to implement a monitoring program approved by the local agency and <br /> 18 specified in the underground storage tank operating pen-nit, in violation of California Code of <br /> 19 Regulations, title 23 section 2632(b); <br /> 20 f. Failing to perfonn periodic testing of secondary containment system, in violation of <br /> 21 California Code of Regulations, title 23 section 2637(a); <br /> 22 g. Failing to have product-tight primary containment, in violation of California Code <br /> 23 of Regulations,title 23 section 2631(a); <br /> 24 h. Failing to record or report any unauthorized release from the underground storage <br /> 25 tank, and any spill or overfill, in violation of California Code of Regulations,title 23 section 2650(b); <br /> 26 and <br /> 27 i. Failing to submit a completed Monitoring System Certification form to the local <br /> 28 agency within thirty(30) days after completion of the inspection, in violation of California Code of <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
