I Regulations,title 23 section 2638(d). <br /> 2 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 3 are doing business in the State of California,in the course of Defendant's PROPERTY AND <br /> 4 GASOLINE TANK OWNER activities, are,pursuant to California Business and Professions Code <br /> 5 section 17204, hereby permanently enjoined from: <br /> 6 a. Violating Health and Safety Code section 25280 et seq., described in paragraph <br /> 7 3 —3i above. <br /> 8 5. Defendants shall pay to Plaintiff the sum of THREE THOUSAND DOLLARS <br /> 9 ($3,000.00),as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment <br /> 10 shall be made pqyable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH <br /> 11 DEPARTMENT-ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be <br /> 12 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> 13 Unit, on or before September 15,2013. <br /> 14 6. Defendants shall pay to Plaintiff the sum of THREE THOUSAND DOLLARS <br /> 15 ($3,000.00), as and for civil penalties,pursuant to Business and Professions Code section 17206. <br /> 16 Said payments shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and <br /> 17 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> 18 Unit, on or before March 15,2014. <br /> 19 7. Defendant shall be penalized, as and for civil penalties,pursuant to Business and <br /> 20 Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 5 <br /> 21 and 6, FIFTEEN THOUSAND DOLLARS ($15,000.00). However, it is stipulated by all parties that <br /> 22 the entire additional FIFTEEN THOUSAND DOLLARS ($15,000.00), in civil penalties shall be <br /> 23 stayed for a period of three(3) years on the following conditions: <br /> 24 a. Defendant will not violate Health and Safety Code sections 25280 et seq., as <br /> 25 described in paragraph 3 above; <br /> 26 b. Defendant will not violate or engage in any of the unlawful acts of unfair <br /> 27 competition as set forth in the First Cause of Action of the Complaint filed in this action, as well as <br /> 28 any other violations of the Business and Professions Code sections 17200 et seq.,including but not <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
