The FIFTEEN THOUSAND DOLLARS ($15,000.00) in civil penalties, described in 3 paragraph 7 above, shall immediately be due and payable as set forth in paragraph 7 above, if the San 4 Joaquin County Office of the District Attorney files Declarations that Defendant violated Health and 5 Safety code sections 25280 et seq. or Business and Professions Code sections 17200 et seq., as 6 described in paragraphs 3 above. Any penalties or other relief sought by Plaintiff for such violations 7 or alleged violations shall be sought by noticed motion. Plaintiff shall notify Defendant in writing of 8 such alleged violations and shall meet and confer with Defendant within twenty (20)business days of 9 such written notice prior to filing any such motion. The Parties shall negotiate in good faith in an 10 effort to resolve any further penalty assessments or other relief pursuant to this paragraph without 11 judicial intervention. Defendant reserves all defenses in law and equity. 12 9. If all the conditions listed in paragraph 7 above are met, then three (3)years from the 13 filing date of this document,the stayed penalty shall be suspended permanently. 14 10. If Defendant sells the business within the three (3) year stayed penalty period to an entity 15 not a family member,then the stayed penalty shall be suspended permanently. 16 11. Defendant shall additionally pay to Plaintiff the sum of FIVE HUNDRED SIXTY-TWO 17 DOLLARS AND FIFTY CENTS ($562.50) as partial recovery of the cost of investigation and suit 18 incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said 19 payment shall be due and pa able to the aforementioned agency, and shall be delivered to the San 20 Joaquin County Office of the District Attorney,Environmental Prosecutions Unit,on or before 21 March 15, 2013. 22 12. Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND DOLLARS 23 ($1,000.00) as partial recovery of the cost of investigation and suit incurred by the San Joaquin 24 County Office of the District Attorney. Said payment shall be due and payable to the 25 aforementioned agency, and shall be delivered to the San Joaquin County Office of the District 26 Attorney,Environmental Prosecutions Unit, on or before March 15, 2013. 27 13. Defendant is responsible for the uniform fee for filing the first paper in a civil action or 28 proceeding in the Superior Court. The amount of the filing fee is FOUR HUNDRED THIRTY-FIVE -4- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
