I limited to Health and Safety Code sections 25280 et seq.. <br /> 2 8. The FIFTEEN THOUSAND DOLLARS ($15,000.00) in civil penalties, described in <br /> 3 paragraph 7 above, shall immediately be due and payable as set forth in paragraph 7 above, if the San <br /> 4 Joaquin County Office of the District Attorney files Declarations that Defendant violated Health and <br /> 5 Safety code sections 25280 et seq. or Business and Professions Code sections 17200 et seq., as <br /> 6 described in paragraphs 3 above. Any penalties or other relief sought by Plaintiff for such violations <br /> 7 or alleged violations shall be sought by noticed motion. Plaintiff shall notify Defendant in writing of <br /> 8 such alleged violations and shall meet and confer with Defendant within twenty (20)business days of <br /> 9 such written notice prior to filing any such motion. The Parties shall negotiate in good faith in an <br /> 10 effort to resolve any further penalty assessments or other relief pursuant to this paragraph without <br /> 11 judicial intervention. Defendant reserves all defenses in law and equity. <br /> 12 9. If all the conditions listed in paragraph 7 above are met, then three (3)years from the <br /> 13 filing date of this document,the stayed penalty shall be suspended permanently. <br /> 14 10. If Defendant sells the business within the three (3) year stayed penalty period to an entity <br /> 15 not a family member,then the stayed penalty shall be suspended permanently. <br /> 16 11. Defendant shall additionally pay to Plaintiff the sum of FIVE HUNDRED SIXTY-TWO <br /> 17 DOLLARS AND FIFTY CENTS ($562.50) as partial recovery of the cost of investigation and suit <br /> 18 incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said <br /> 19 payment shall be due and pa able to the aforementioned agency, and shall be delivered to the San <br /> 20 Joaquin County Office of the District Attorney,Environmental Prosecutions Unit,on or before <br /> 21 March 15, 2013. <br /> 22 12. Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND DOLLARS <br /> 23 ($1,000.00) as partial recovery of the cost of investigation and suit incurred by the San Joaquin <br /> 24 County Office of the District Attorney. Said payment shall be due and payable to the <br /> 25 aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br /> 26 Attorney,Environmental Prosecutions Unit, on or before March 15, 2013. <br /> 27 13. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br /> 28 proceeding in the Superior Court. The amount of the filing fee is FOUR HUNDRED THIRTY-FIVE <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
