Administrative Costs associated with this Transmittal are shared by the <br /> Department of Environmental Health(DEH)Budget Unit 261,Cost Center 1196, Fund 0030,and the Vector Control <br /> District(VCD)Budget Unit 411,Cost Center 4224,Fund 0028. <br /> CONTRACT HISTORY <br /> None <br /> REASONS FOR RECOMMENDATION <br /> Acceptance of reports will ensure that the Board is kept informed and updated on the status of Olivera Foods Poultry <br /> Ranch,4140 Canada Road,Gilroy,CA,concerning prevailing conditions as noted on weekly inspection reports prepared <br /> by the Department. <br /> The Operator of this facility,Olivera Food,Inc.,has demonstrated significant improvement in adult fly control as <br /> determined by weekly adult fly spot card counts for the past year. Because of this operational improvement,it is <br /> recommended by the Department to reduce the reporting frequency to the Board from quarterly to twice per year.The <br /> Department will continue to monitor the poultry facility on the same weekly schedule,however,report backs to the <br /> Board will be modified to coincide with the historical months of increased adult fly activity. Reports to the Board are <br /> proposed as follows: first reporting period will be May,June,and July with a report to the Board at the first meeting in <br /> August;second reporting period will be August,September,and October with a report to the Board first meeting in <br /> November. A report will automatically be transmitted to the Board as outlined in the Compliance Agreement in the <br /> event that the weekly Departmental inspection discloses the adult fly spot count in excess of a weekly average of 75. <br /> BACKGROUND <br /> In 2003,at the direction of Board Chairperson,Supervisor Blanca Alvarado,the Department was directed to provide a <br /> quarterly report relating to the inspection assessments of Olivera Egg Ranch,4140 Canada Road,Gilroy CA.This <br /> request was the result of the public hearing on February 25,2003 to hear the appeal by the ranch operator of the Board's <br /> preliminary finding of a public nuisance.The Board issued a finding of no public nuisance at this time,but had serious <br /> concerns about past operational deficiencies.As a result,the Board directed the Department to work with the property <br /> owner and facility operator to ensure that the ranch would operate consistently with accepted standards and practices for <br /> a commercial poultry operation. <br /> The last report that was presented to the Board indicated that the commercial poultry facility was successfully <br /> controlling fly populations at 4140 Canada Road,Gilroy. Since the last report,adult fly control as indicated by spot card <br /> counts continues to indicate low adult fly abundance at this facility.This report provides copies of the last 13 inspections <br /> of the facility conducted from August 1,2004 thru October 31,2004 by the Department. (Attachment#1)Included in the <br /> report is a compilation of the adult fly spot card count averages.
