Milliken Ave., Suite 4100 <br /> Ontario, CA 91761-7898 <br /> RE: 4140 Canada Road—Commercial Poultry Operation <br /> Dear Mr. Olivera, <br /> Please find attached the Notice to Abate order as well as supporting documentation that was presented to <br /> the County of Santa Clara Board of Supervisors on November 19, 2002 after review and concurrence <br /> with legal counsel. The County Board of Supervisor at its regularly scheduled board meeting has made a <br /> preliminalr ruling based upon the evidence submitted that the commercial poultry operation located at <br /> 4140 Canada Road, Gilroy, California does meet the criterion for a public nuisance. <br /> It is not the intent to cause undue hardship on Olivera Foods or Certified Egg Farms Inc,. However, it is a <br /> legal requirement that the operator/owner of any poultry operation operate in such a way that it does not <br /> significantly affect the quality of life for those residents who live in close proximity to the commercial <br /> poultry operation. <br /> The Vector Control District is compelled to take this action based upon evidence that Olivera Foods, <br /> operator of the poultry facility, has not sufficiently addressed immature and adult fly control at the ranch. <br /> The inability to control flies at the source (poultry ranch) has caused an adverse affect on the quality of <br /> life for the residents surrounding the commercial poultry ranch. <br /> The finding is a preliminary finding by the County of Santa Clara Board of Supervisors. Should Olivera <br /> Foods as the ranch operator or Certified Egg Farms Inc. as property owner, contest the Notice to Abate <br /> you (they) have the right to appeal at a public hearing on December 10, 2002 prior to a final finding by the <br /> Board of Supervisors.
