Milliken Ave. <br /> 3315 Sierra Road Suite 4100 <br /> San Jose, CA 132 Ontario, CA 91761-7898 <br /> Vector Control District <br /> NOTICE TO ABATE <br /> California Health and Safety Code (Sections 2274, 2275 and 2281 and Sections 2000 et al effective <br /> January 1, 2003) <br /> YOU ARE HEREBY NOTIFIED that the County of Santa Clara Board of Supervisors, Trustees of the <br /> County of Santa Clara Vector Control District, made a preliminary finding that a public nuisance exists at <br /> the following property located at: <br /> 4140 Canada Road, Gilroy California <br /> This finding is based upon the following: <br /> 1)The presence of adult and immature domestic flies in numbers considerably in excess <br /> of those in the surrounding environment; <br /> 2)The presence of adult and immature domestic flies is the result of design, layout, and <br /> management of the poultry facility; <br /> 3)The adult flies disseminate widely from the property; <br /> 4)The presence of adult domestic flies cause detrimental effects on the public health and <br /> well being of a majority of the surrounding population, as determined by the Board of <br /> Supervisors. <br /> This finding is also based on the newly revised California Health and Safety Code Section 2000 et al, <br /> definition of a public nuisance that takes affect on January 1, 2003: <br /> 1)The property design and layout of the agricultural operation does not minimize the <br /> opportunity for fly development. <br /> 2)The poultry ranch lacks an integrated pest management program intended to control the <br /> development and harborage of flies, including the components of surveillance, <br /> management, containment and control. <br /> Attached is a copy of the County of Santa Clara Vector Control District Transmittal used by the County of <br /> Santa Clara Board of Supervisors to make this preliminary finding on November 19, 2002. <br /> Board of Supervisors: Donald F.
