e <br /> 5 <br /> NOTICE To ABATE <br /> NOVEMBER 20,2002 <br /> PAGE 2 <br /> As the owner and/or party in possession of the above-described property, YOU ARE DIRECTED to abate <br /> the nuisance on or before by December 19, 2002, by destroying the adult and immature flies that are now <br /> present on the property. Fly spot abundance cards located in the poultry houses and whose results are <br /> recorded on the Department of Environmental Health Poultry Ranch Inspection Form that exceed an <br /> average of fifty(50)fly spot per week will be evidence that the poultry operation at 4140 Canada Road, <br /> Gilroy is out of compliance and is causing a public nuisance. <br /> YOU ARE FURTHER DIRECTED to perform on a routine basis any and all work necessary to prevent the <br /> recurrence of domestic fly breeding at the location(s) specified in the Department of Environmental Health <br /> Poultry Ranch Inspection notice as long as you or your agents continue to operate the poultry facility. Any <br /> condition that is marked unsatisfactory will be evidence that the operation at 4140 Canada road is out of <br /> compliance and is causing a public nuisance. <br /> Failure to abate the fly nuisance or correct conditions so that they are no longer unsatisfactory within the <br /> time specified will subject you to civil penalties of not more than five hundred dollars ($500.00), to <br /> increase to one thousand ($1000) after January 1, 2003, per day the nuisance continues after the time <br /> specified for the abatement of the nuisance in this notice. Any recurrence of the nuisance will be deemed <br /> to be a continuation of the original nuisance. <br /> YOU ARE FURTHER NOTIFIED that before complying with the requirements of this Notice, you may <br /> appear at a hearing before the Board of Supervisors, sitting as the Trustees of the County of Santa Clara <br /> Vector Control District, at which the Board shall determine whether the preliminary findings as set forth in <br /> this Notice are correct. You will have the opportunity to present testimony on your behalf.
