Attachment 8 <br /> Feb. 12, 2002 <br /> Ed Olivera, Jr. <br /> Olivera Foods <br /> 3315 Sierra Rd. <br /> SanJose,CA 95132 <br /> RE:Olivera Egg Farm at 4140 Canada Rd., Gilroy <br /> Dear Mr. Olivera: <br /> This letter is sent concerning a recent three week period beginning with the end of <br /> January where unsatisfactory conditions were observed at the referenced facility during <br /> and just after the removal of the birds for flock rotation. The unsatisfactory conditions led <br /> to renewed fly breeding even though fresh manure was not being produced. These recent <br /> inspections from Jan 31, 2001 through Feb. 21, 2002 illustrated the need for improved <br /> operations during bird load-out, especially when this occurs during the warmer seasons. <br /> Better planning and timing could have allowed regular cleaning of the buildings and <br /> manure removal prior to and immediately after the birds were removed. Routine clean-up <br /> and removal of wastes and dead birds must not be sacrificed or deemed unnecessary <br /> during and after bird removal. Similarly,maintenance and repair of the leaking water <br /> system should not be neglected during and after bird removal, because the manure <br /> knocked off of shields and support structure during the cleaning process allow breeding <br /> cycles to continue when wetted by water leaks. <br /> Another unsatisfactory condition that was observed on Feb. 7, 2002 was that a large <br /> amount of uncovered manure was left out on the loading pad during rain. Although a tarp <br /> is available for use in covering the manure left outside during rain or expected rain <br /> events, it was not used. This department is obligated to report all pollution issues to the <br /> appropriate agencies. Thus, this is being reported to the Regional Water Quality Control <br /> Board(Board) as a violation of the agreed upon plan to minimize run-off contamination. <br /> The staff training and oversight that could have prevented this was apparently lacking. <br /> Any further failure of this nature could lead to Board penalties and or the requirement to <br /> build a permanent cover structure. <br /> The final purpose of this letter is to enumerate the repairs and improvements the <br /> Department of Environmental Health expects you to complete prior to restocking the <br /> facility with a new flock of chickens. The following must be completed: <br /> 1. Repair broken grout between concrete blocks around the manure loading pad. <br /> 2. Provide the necessary curbs,berms and improved drainage systems around the <br />
