Attachment 8
Feb. 12, 2002
Ed Olivera, Jr.
Olivera Foods
3315 Sierra Rd.
SanJose,CA 95132
RE:Olivera Egg Farm at 4140 Canada Rd., Gilroy
Dear Mr. Olivera:
This letter is sent concerning a recent three week period beginning with the end of
January where unsatisfactory conditions were observed at the referenced facility during
and just after the removal of the birds for flock rotation. The unsatisfactory conditions led
to renewed fly breeding even though fresh manure was not being produced. These recent
inspections from Jan 31, 2001 through Feb. 21, 2002 illustrated the need for improved
operations during bird load-out, especially when this occurs during the warmer seasons.
Better planning and timing could have allowed regular cleaning of the buildings and
manure removal prior to and immediately after the birds were removed. Routine clean-up
and removal of wastes and dead birds must not be sacrificed or deemed unnecessary
during and after bird removal. Similarly, maintenance and repair of the leaking water
system should not be neglected during and after bird removal, because the manure
knocked off of shields and support structure during the cleaning process allow breeding
cycles to continue when wetted by water leaks.
Another unsatisfactory condition that was observed on Feb. 7, 2002 was that a large
amount of uncovered manure was left out on the loading pad during rain. Although a tarp
is available for use in covering the manure left outside during rain or expected rain
events, it was not used. This department is obligated to report all pollution issues to the
appropriate agencies. Thus, this is being reported to the Regional Water Quality Control
Board(Board) as a violation of the agreed upon plan to minimize run-off contamination.
The staff training and oversight that could have prevented this was apparently lacking.
Any further failure of this nature could lead to Board penalties and or the requirement to
build a permanent cover structure.
The final purpose of this letter is to enumerate the repairs and improvements the
Department of Environmental Health expects you to complete prior to restocking the
facility with a new flock of chickens. The following must be completed:
1. Repair broken grout between concrete blocks around the manure loading pad.
2. Provide the necessary curbs, berms and improved drainage systems around the
