manure loading pad to preclude the movement of surrounding slope runoff from
entering the pad drainage system.
3. Provide effective drainage control structures, permanent or temporary, that will
keep pad runoff water from entering into the end of building#1. The past use of a
windrow of manure and dirt placed at the sliding doors is unacceptable.
4. Replace or re-attach all broken wooden walls inside of the manure pits of both
buildings. Not only shall the walls be firmly reattached, but the bottom floor wall
juncture of the entire perimeter must be sealed tight so that larvae of flies may not
enter the void space between the refurbished wooden inner walls and the
deteriorated metal outer walls.
5. Eliminate any plastic cage shields that are so inaccessible that cleaning cannot
occur on a weekly basis. Repair cage shield scraping equipment that is not
operating to the design standards. Scraping should remove collected manure and
not leave behind a 2 to 3 inch thick layer of manure.
6. Install the approved sewage disposal system with a small septic(settling tank) and
leaching trench to handle wastes from the janitorial sink in the egg packing room.
Failure to comply with the directives of this letter will result in appropriate enforcement
actions. An injunction maybe sought through the District Attorney's office to block
movement of new birds onto this site if the above corrections are not completed before
the end of the third week of April 2002.
Please feel free to contact Mr. Ballard, Vector Control(299- 2050) or Chris Rummel,
Solid Waste Enforcement(299-6930), of the Santa Clara County Department of
Environmental Health, if you have any questions.
Sincerely,
Chris Rummel, R.E.H.S.
Solid Waste Enforcement Program
Hazardous Materials Compliance Division
John Ballard
Santa Clara County Vector Control District
Cc: Michael Mills, President, Olsen Farms or Certified Egg Farms Kimberly Gonzales,
Regional Water Quality Control Board
