MM 4.5-6. <br /> a) To prevent and avoid any future impacts to the integrity of the well casing and soil column,the <br /> established 50-foot diameter existing soil column buffer around the plugged and abandoned oil <br /> well will be marked and maintained for future operations. Wastes will be disposed of up <br /> against this soil buffer, such that no voids would occur. The buffer will be periodically <br /> inspected to confirm that its integrity has not been compromised during operations. An initial <br /> inspection will be scheduled with DOGGR staff prior to April 15,2008. <br /> b) In the event that any structures will be built by the Project within the buffer zone with the <br /> potential to impact the two plugged and abandoned oil wells (API # 09261186 and API # <br /> 02935128)the Bakersfield Office of the Department of Conservation, Division of Oil, Gas, and <br /> Geothermal Resources(DOGGR) shall be contacted to inspect the wells and to recommend and <br /> approve any remediation required. <br /> Potential Significant Effect <br /> Without appropriate mitigation, the project may encounter presently unknown oil and gas or injection <br /> wells. <br /> Description of Specific Impact <br /> While the existing pits on the Project site have been already excavated, and the possibility is low of <br /> encountering such unknown wells during future operations, a portion of the Project site is within a <br /> designated oil field. Given this setting, during construction and continued operations there is a possibility <br /> that site development activities may encounter previously unknown oil and gas or injection well casings. <br /> Should site preparation activities uncover a previously unknown oil and gas or injection well casing, the <br /> proper abandonment of such feature in accord with Department of Oil, Gas and Geothermal Resources <br /> regulations and standards would reduce any impacts to less than significant. <br /> Finding <br /> Changes or alterations have been required in, or incorporated into the project that substantially lessen the <br /> potentially significant effect as identified in the Final EIR, so that environmental effects after such <br /> mitigation are reduced to a less than significant level. <br /> Brief Explanation of the Rationale for the Finding <br /> Pursuant to Public Resources Code Section 21081(a)(1), the Board of Supervisors finds that the project's <br /> adherence to the following mitigation measure will reduce the potential impact of this significant effect to <br /> a less than significant level: <br /> MM 4,5-7. <br /> If during grading, excavation or any other activity, any plugged and abandoned or unrecorded wells are <br /> uncovered or damaged, the Bakersfield Office of the Department of Conservation/Division of Oil, Gas, <br /> and Geothermal Resources shall be contacted to inspect the well and to approve any remediation required. <br /> Should remedial actions be required, the applicant will be responsible for implementing the Department- <br /> required corrective action. <br /> Findings of Fact—Section 15091 March 15,2016 <br /> H.M.
