was granted in accordance with WDR Order No. 97-078, contingent upon the installation of a <br /> groundwater monitoring system at each pit, prior to waste discharge. Note, that the RWQCB are <br /> currently revising the WDRs to reclassify the mine pits as a Class III landfill for discharge of industrial <br /> waste(Volume I,Appendix 1). <br /> In July 2003, a "Liner Performance Report" for Pits "E," "F," and "G" (Hersh Consulting 2003a) was <br /> submitted to the RWQCB for review and approval(see Appendix D). The report covered the period from <br /> December 1993 through March 2003. This report is currently under review by the RWQCB staff. The <br /> purpose of the report was to demonstrate that the facility's characteristics are adequate to meet the Class <br /> III non-municipal solid waste (MSW), non-hazardous waste landfill (known as a Class III Industrial <br /> Waste landfill) siting and geologic criteria and construction standards contained in Title 27 California <br /> Code of Regulations (CCR), and that a liner would not be required. The RWQCB's findings regarding <br /> Pits "E," "F," and"G's" suitability will be incorporated into the revised WDR that will be issued for the <br /> proposed Project. In order for the proposed waste discharges to occur,the subject Pits will either have to <br /> be found to be in compliance with these criteria, or else provide a conforming liner. Otherwise the <br /> proposed waste discharges would not be authorized. <br /> In 2004 a Supplementary Characterization Report "F&G Connection" Pit to the Site Characterization <br /> Report for Pits "F"and"G"was prepared (Hersh Consulting 2004a)(see Appendix E-1). The purpose of <br /> the report was to demonstrate Pit F/G.characteristics are adequate to meet the Class III non-MSW, non- <br /> hazardous waste landfill siting and geologic criteria and construction standards.contained in Title 27 <br /> CCR, and that a liner would not be required. This report was submitted in July 2004 to the RWQCB. <br /> The RWQCB's findings regarding the Pit"F/G Connection Area's" suitability will be incorporated into a <br /> revised WDR for the proposed Project. In order for the proposed waste discharges to occur, the subject <br /> Pit will either have to be found to be in compliance with these criteria, or else provide a conforming liner. <br /> Otherwise the proposed waste discharges will not be authorized. <br /> The inclusion of biosolids in the permitted waste streams will require Project design and operation <br /> mitigations to assure that no degradation of ground water will occur. Such mitigations must include both <br /> supplemental protection against groundwater infiltration from disposal leachate and protection against <br /> groundwater degradation from washout of biosolids delivery trucks and Project equipment serving the <br /> biosolids disposal area. These activities constitute a potentially significant impact which must be <br /> mitigated. <br /> Finding <br /> Changes or alterations have been required in, or incorporated into the project that substantially lessen the <br /> potentially significant effect as identified in the Final EIR, so that environmental effects after such <br /> mitigation are reduced to a less than significant level. <br /> Brief Explanation of the Rationale for the Finding <br /> Pursuant to Public Resources Code Section 21081(a)(1), the Board of Supervisors finds that the project's <br /> adherence to the following mitigation measures will reduce the potential impact of this significant effect <br /> to a less than significant level: <br /> MM 4.6-1. <br /> a) The proposed Project waste streams cannot be subject to the disposal reporting systems.
