circulation of the DE comments were received from Kern County Waste <br /> IR, ty Management regarding the <br /> impact of this project on public facilities(landfills)..This could impact the County's Diversion goals and <br /> compliance with California law(AB 939)and so represents a potentially significant impact to Public <br /> Services by jeopardizing Kern County's compliance with state regulations related to solid waste <br /> (Environmental Checklist XVI(g)). Five of the waste streams for disposal by this project,biosolids, <br /> spent sandblast media,treated auto shredder waste,cogeneration ash(fly ash)and lime filter cake, if <br /> generated within Kern County,would represent a negative impact to the County's diversion efforts if <br /> subject to disposal reporting criteria. The California Integrated Waste Management Board(CIWMB) <br /> determines,based on the category of Landfill permit(Class I,II or III),the level of reporting required of <br /> waste streams. In addition there is a process to request an exemption of certain wastes from the disposal <br /> reporting criteria. To ensure that there are no negative impacts on the County's mandated requirements to <br /> achieve the 50% diversion goal,mitigation measures have been clarified to restrict the permit for five <br /> wastes streams(Dewatered Class A or B biosolids, spent sandblast media, fly ash treated auto shredder <br /> waste and lime filter cake)to a permit that does not require disposal reporting. With the imposition of the <br /> following revised mitigation measures the impacts to public services can be considered less than <br /> significant. <br /> Finding <br /> Changes or alterations have been required in, or incorporated into the project that substantially lessen the <br /> potentially significant effect as identified in the Final EIIt, so that environmental effects after such <br /> mitigation are reduced to a less than significant level. <br /> Brief Explanation of the Rationale for the Finding <br /> Pursuant to Public Resources Code Section 21081(a)(1), the Board of Supervisors finds that the project's <br /> adherence to the following mitigation measures will reduce the potential impact of this significant effect <br /> to a less than significant level: <br /> Mitigation Measure 4.5-3 This facility shall only accept dewatered Class A and B biosolids, <br /> treated auto shredder waste, fly ash, spent sandblast media and lime filter cake. Verification must <br /> be obtained from the State (CIWMB) of a solid waste facilities permit that is not subject to the <br /> Disposal Reporting Waste System or an exemption to disposal reporting criteria of these wastes <br /> must be submitted to the LEA and the Planning Department prior to acceptance of waste. <br /> Acceptance of the following waste streams, (shredded auto tires, concrete/cement rubble, <br /> designated asphalt products and chipped construction lumber) shall be prohibited either for <br /> disposal or for beneficial use. A Loadcheck Program, as required by Title 27 and Title 14, <br /> [Quality Assurance/Quality Control Program Plan] shall also be developed and submitted to the <br /> Local Enforcement Agency for approval prior to the acceptance of waste. The Loadcheck <br /> program and quality assurance/quality control program will be submitted to the Planning Department <br /> after LEA approval. <br /> C. Effects Of The Project That Cannot Be Mitigated To A Level Less Than Significant. <br /> None <br /> D.
