In the event that actively <br /> nesting birds are found within the permit area, <br /> nests, eggs, and young will be avoided until the <br /> young have fledged unless appropriate permits are <br /> obtained. As discussed below, all employees and <br /> contractors will be subject to a Sensitive Species <br /> Training Program. A qualified biologist will be <br /> retained to make a determination as to when <br /> fledging has occurred. Alternatively, the site <br /> could be evaluated the following <br /> December/January during the annual survey for <br /> potential nest sites to determine a course of action. <br /> d) A barbed wire fence will be placed around all the <br /> receiving pits with and along the Solid Waste <br /> Facility Permit Area at the direction of the <br /> owner/operator and Local Enforcement Agency <br /> (LEA) (see Figure 4.2-1 for preliminary location <br /> and alignment). The final location of the <br /> perimeter fencing shall be as approved by and on <br /> file with the 'LEA in plans submitted by the <br /> applicant.
