I d. Failing to maintain and operate a facility to minimize the possibility of a fire, <br /> 2 explosion,or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br /> 3 California Code of Regulations,title 22 section 66265.31; <br /> 4 e. Storing hazardous waste onsite longer than one hundred eighty(180)days, in <br /> 5 violation of California Code of Regulations,title 22 section 66262.34(d); <br /> 6 f. Failing to maintain modified emergency coordinator information, in violation of <br /> 7 California Code of Regulations,title 22 section 66262.34(d)(2); <br /> 8 g. Failing to retain a signed copy of manifests for at least three(3)years from the date <br /> 9 the waste was accepted by the initial transporter, in violation of California Code of Regulations,title <br /> 10 22 section 66262.40(a); <br /> 11 h. Failing to contact the transporter and/or the owner or operator of the designated <br /> 12 facility which was to receive the hazardous waste to determine the status of the hazardous waste <br /> 13 after the generator did not receive a copy of the manifest with the handwritten signature of the <br /> 14 owner or operator of the designated facility within thirty-five(35)days of the date the waste was <br /> 15 accepted by the initial transporter, in violation of California Code of Regulations, title 22 section <br /> 16 66262.42(a); <br /> 17 i. Failing to submit an Exception Report after the generator did not receive a copy of <br /> 18 the manifest with the handwritten signature of the owner or operator of the designated facility which <br /> 19 was to receive the hazardous waste within forty-five(45)days of the date the waste was accepted by <br /> 20 the initial transporter, in violation of California Code of Regulations,title 22 section 66262.42(b); <br /> 21 j. Failing to use a bill of lading to record the transfer of used oil filters, in violation of <br /> 22 California Code of Regulations,title 22 section 66266.130(c)(5); <br /> 23 k. Failing to train facility personnel in hazardous waste management procedures <br /> 24 relevant to the positions in which they are employed, in violation of California Code of Regulations, <br /> 25 title 22 section 66265.16;and <br /> I <br /> 26 i. Failing to retain each record of each shipment of universal waste sent from the <br /> 27 universal waste handler's facility to another facility for at least three(3)years from the date of <br /> 28 <br /> -5— <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
