I departure of the corresponding shipment of universal waste,in violation of California Code of <br /> Regulations,title 22 section 66273.39(d)(2). <br /> 3 5. Defendants with actual or constructive knowledge of this Injunction,only in so far as they <br /> 4 are doing business in the State of California, in the course of Defendant's GAS SALES/MINI- <br /> 5 MART activities,pursuant to California Business and Professions Code, section 17204, are <br /> 6 permanently enjoined from: <br /> 7 a. Violating Health and Safety Code section 25280 et seq.,as described above in <br /> 8 paragraphs 3—3w;and <br /> 9 b. Violating Health and Safety Code section 25100 et seq.,as described above in <br /> 10 paragraphs 4-4i. <br /> 11 6. Defendant shall pay to Plaintiff the sum NINETY THOUSAND DOLLARS($90,000.00). <br /> 12 as and for civil penalties,pursuant to Business and Professions Code section 17206. Said payment <br /> 13 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 1.1 Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, according to the <br /> 15 Payment Schedule attached as Exhibit A. <br /> 16 7. Defendant shall pay to Plaintiff the sum NINETY THOUSAND DOLLARS($90,000.00). <br /> 17 as and for civil penalties,pursuant to Health and Safety Code section 25299. Said payment shall be <br /> 18 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT— <br /> 19 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br /> 20 Joaquin County Office of the District Attorney,Environmental Prosecutions Unit,according to the <br /> 21 Payment Schedule attached as Exhibit A. <br /> 22 8. Defendant shall additionally pay to Plaintiff the sum SEVEN THOUSAND FIFTY <br /> 23 DOLLARS($7,050.00)as partial recovery of the cost of investigation and suit incurred by the SAN <br /> 24 JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall be due <br /> 25 and pale to the aforementioned agency, and shall be delivered to the San Joaquin County Office <br /> 26 of the District Attorney,Environmental Prosecutions Unit,according to the Payment Schedule <br /> 27 attached as Exhibit A. <br /> 28 <br /> -6- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
