WASTE DISCHARGE REQUIREMENTS ORDER R5-2013-0028 -2- <br /> DELICATO VINEYARDS, INC. <br /> DELICATO FAMILY VINEYARDS <br /> SAN JOAQUIN COUNTY <br /> into approximately 23 acres of uncropped LAAs. Wastewater is applied to the <br /> LAAs by flood irrigation and is then passively treated by the soil and limited <br /> vegetative growth. <br /> 6. Facility expansion plans include constructing two 0.25 MG lined aeration ponds, <br /> increasing the volume of wastewater discharge, increasing the size of LAAs to <br /> include approximately 130 acres of cropped land, and converting two unlined <br /> ponds into temporary storage for supplemental irrigation water. Therefore, Order <br /> 96-077 is rescinded and replaced by this Order. <br /> Enforcement History <br /> 7. On 15 September 2003, Board staff issued a Notice of Violation (NOV) to the <br /> Discharger for violation of the Groundwater Limitations contained in WDRs Order <br /> 96-077 because groundwater monitoring data showed that shallow groundwater <br /> quality had been degraded with salinity constituents. The NOV required submittal <br /> of a Groundwater Degradation Evaluation Report to evaluate the extent to which <br /> wastewater discharge was degrading underlying groundwater. <br /> 8. On 29 December 2003, the Discharger submitted a report titled Report: <br /> Groundwater Degradation Evaluation Delicato Vineyards. The report concluded <br /> that wastewater application practices were contributing to the degradation of <br /> groundwater quality in the vicinity of the LAAs. The report also stated that the <br /> Discharger was assessing its process chemical usage and attempting to reduce <br /> the salinity of the discharge. <br /> 9. Cleanup and Abatement Order R5-2004-0705 (CAO) was issued on 27 April 2004. <br /> The CAO required submittal of a Wastewater Characterization and Wastewater <br /> Treatment Evaluation Report, a Wastewater System Improvement Plan and Final <br /> System Design, and quarterly progress reports describing work accomplished to <br /> comply with the Order. <br /> 10. A Wastewater Characterization and Treatment Evaluation Report that summarized <br /> wastewater characteristics and a proposed compliance plan were submitted on <br /> 1 December 2005. In accordance with the CAO, the Discharger submitted a RWD <br /> on 28 April 2006, and began providing quarterly progress reports detailing facility <br /> improvements and implementation of salinity reduction efforts. <br /> 11. The Discharger met with Board staff in August 2008 to discuss expanding the <br /> LAAs. The Discharger was asked to install monitoring wells in the proposed LAAs <br /> to identify background groundwater conditions. A Monitoring Well Installation <br /> Workplan was submitted on 11 April 2008, and three monitoring wells were <br /> installed in August 2008. <br />
