Violation #57-Failed to manage incompatible wastes in containers properly 66265.17 <br /> CCR. <br /> At time of inspection, facility was storing mixed waste aerosol cans, without any knowledge of <br /> compatibility. <br /> Immediately, segregate incompatible wastes.All incompatible wastes must be <br /> managed and stored separately. <br /> Violation #77, 82 and 83-Failed to properly manage, mark, and store universal waste <br /> (UW) 66273.33(a)-66273.35CCR. <br /> Alkaline battery in the staging area was not stored or labeled pursuant to regulations. <br /> Within 30 days of receipt of this inspection report, have this universal waste removed <br /> and provide this office with a shipping record. Begin to manage all universal waste <br /> pursuant to 6627333(a)-66273.35 for future storage. <br /> Violation #93-Proper waste handling and emergency procedures 40 CFR Section <br /> 262.34(d)(5)(iii) The generator must ensure that all employees are thoroughly <br /> familiar with proper waste handling and emergency procedures, relevant to their <br /> responsibilities during normal facility operations and emergencies. <br /> At time of inspection Crystal Xavier, lead Merchandise Claims &Control (MC&C) clerk, was in <br /> charge of the hazardous waste storage area, area 605. When Crystal is on her scheduled days <br /> off, Stella Jaurigue, Cashier or Amber Walker, Cash office employee will fill in for her in area 605. <br /> According to the training documentation and admission by Kmart staff these two employees have <br /> not received hazardous waste training to satisfy CFR. <br /> Within 30 days of receipt of this inspection report,provide proof that employees are <br /> thoroughly familiar with proper waste handling and emergency procedures. Provide <br /> copy of training program. <br /> Within 30 days of receipt of this inspection report, complete and submit a copy of the <br /> Return to Compliance Certification, found on the back of page 1, with a statement <br /> addressing how each of the above listed violations have been corrected, Submit all <br /> requested and necessary supporting documentation. <br /> Note;All EHD staff time associated with failing to comply by the above noted dates <br /> will be billed at the current hourly rate.
