The Company hereby disputes the violations for reasons <br /> explained below. Because the Company is disputing certain violations, the Company <br /> cannot execute the Return to Compliance Certification as requested for these items. <br /> Item 102: Failed to determine if a waste is a hazardous waste or retain waste analysis <br /> on site for 3 years. <br /> Response: The remarks contained in the inspection report for Item 102 are incorrect. <br /> The Company does not generate hazardous waste during its cross dock process at its <br /> Stockton Facility and therefore denies this allegation. When Stockton Logistics delivers <br /> product to its retail customers, the Company receives certain items for salvage, such as <br /> pallets and recyclable materials. The Company also receives resaleable goods enclosed <br /> in banana boxes. The banana boxes are loaded onto trucks, cross docked at the Stockton <br /> Facility and are ultimately transported to it's Sacramento Reclamation Center. Once <br /> unloaded, the banana boxes are opened and the individual items are inspected and sorted <br /> for purposes of reclamation. Product that is saleable is sorted, boxed and typically sold to <br /> food salvage companies. Product that is deemed as nonsaleable is set aside, and at that <br /> point may be determined to be waste. In accordance with Company policy, any waste <br />
