Bills of lading for the recycling of used oil filters for 2018, 2017, and 2015 were not found on site. A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading for used oil filters for the last three years, maintain them on site, and submit copies to the EHD. A 55-gallon black drum labeled as and containing drained used oil filters was found with the lid open, several oil filters and used oil sitting on top of the lid, and lacking an accumulation start date.A 55-gallon red drum containing used oil filters and a torn label that read used oil filters was found open under a table in the middle of the shop. The label on the red drum of filters also lacked an accumulation start date.A 5-gallon blue bucket containing used oil and two oil filters was found open and unlabeled. Christopher Becker, a mechanic and owner of the business, placed the two filters from the bucket into the black used oil filter drum. Facilities that generate up to one ton of used oil filters per year may store the filters up to one year. Facilities that generate one ton or more of used oil filters may store the filters for up to 180 days. Since it cannot be determined how long these oil filters have been on site, immediately recycle these filters under a bill of lading and submit a copy of the bill of lading to the EHD. Used oil filters shall be drained of free-flowing oil, stored in a closed, rainproof container, labeled as"drained used oil filters,"and marked with an accumulation start date. Immediately drain any undrained filters, containerize the filters in a closed container, and ensure the containers are properly labeled, including the accumulation start date. Ensure that all used oil filters are managed in this way. Since it cannot be determined how long these oil filters have been on site, immediately recycle these filters under a bill of lading and submit a copy of the bill of lading to the EHD. This is a repeat violation, Class II. Overall Inspection Comments: An inspection checklist was provided to the facility operator at the time of inspection. The report was amended by the EHD. The EHD has written the complete report, on 8/28/2018, which replaces the initial checklist. Notes: -The amount of hazardous waste generated in the last calendar year could not be determined at the time of inspection due to missing hazardous waste manifests. - Provided at the time of inpsection: hazardous waste labels, hazardous waste labeling guidance, EPA ID number application, Small Business Hazardous Waste Disposal Program Brochure, and List of free CUPA classes. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, within 30 days of receiving the complete inspection report.
