Mr. Chandler Martin - 20 December 1993 <br /> conversations with Department of Public Works Staff,the entrance already meets the <br /> County standard. <br /> • Condition 3 - Since there will be no need for improvements to the entrance, we <br /> understand that this Condition does not apply. If in the future, Scotts does any work <br /> in the right of way, they will obtain the necessary permits. <br /> • Condition 4 - The Traffic Impact Mitigation Fee is required for the facility. <br /> WESTON is calculating the increasenumber of"trip ends"for the new development <br /> and Scotts will submit the corresponding fee within the stipulated timeframe. <br /> • Condition 5 - WESTON obtained a copy of the Resolution R-91-327 and confirmed <br /> that the Water Supply Facilities Impact Mitigation Fee does not apply since Scotts <br /> is not applying for a building permit or planning to alter the building structures or <br /> water supply facilities. The resolution states that there shall be no fee for the <br /> following: <br /> '°any alteration or addition to a non-residential structure if the square footage <br /> of the structure is not increased more than ten percent or 200 square feet, <br /> whichever is less." <br /> Public Health Services <br /> Scotts had requested to hold open the appeal process for an additional two weeks while <br /> these issues and Development Title Sections were further investigated. Scotts now <br /> withdraws the appeal based on the current understanding of these issues being as follows: <br /> • Condition 1: Scotts will submit a workplan to the Environmental Health Division <br /> site mitigation unit for further investigation of the former diesel tank location. <br /> • Condition 2: This is a standard Condition of Approval and WESTON has discussed <br /> with Public Health Services Staff that a Solid Waste Facilities Permit cannot be <br /> obtained until a local conditional use permit and all other local permits are obtained <br /> for the site. <br /> • Condition 4: Scotts will address this issue in the Improvement Plan to comply with <br /> the County Development Title Section. <br /> • Condition 7: Scotts will address this issue in the Improvement Plan to comply with <br /> the County Development Title Section. <br /> • Condition 9: Based on conversations with Public Health Services Staff, this is a <br />
