11.0 LIMITATIONS <br /> This SSCR has been prepared for the exclusive purpose of processing of a land <br /> use application through the San Joaquin County Environmental Health <br /> Department. It is authorized for use only by the client, the property owner, and <br /> the San Joaquin County Environmental Health Department, and for a maximum <br /> time period of six months from its date of completion. The standard of care <br /> employed is typical for this type of report. Live Oak does not represent that all <br /> existing or potential contamination has been identified, although an attempt has <br /> been made to identify typical contamination sources. The SSCR is a document <br /> specific to the San Joaquin County Development Title, §9-905.12; it is not <br /> equivalent to a Phase I Environmental Site Assessment (ESA), does not comply <br /> with ASTM E 1527, cannot be used to provide Landowner Liability Protections <br /> under CERCLA, and does not claim to identify "recognized environmental <br /> conditions." Any interested parties are advised to obtain a Phase I ESA before <br /> making decisions related to the presence or absence of recognized <br /> environmental conditions on the Site. This report is not to be used to determine <br /> compliance with local, State, or Federal requirements, including but not limited to <br /> water quality, septic system performance, waste discharge, and hazardous <br /> materials handling. This report relies on many sources; Live Oak cannot warrant <br /> the accuracy or completeness of information provided by those sources. <br /> Furthermore, no sample collection and analysis has been performed as part of <br /> this report; without soil and groundwater analysis, all conclusions of this report <br /> should be considered professional opinion, not scientific certainty. Site <br /> conditions and regulatory guidelines are subject to change and may invalidate <br /> portions of this report. This report and its recommendations in no way fulfill or <br /> reduce the property owner's responsibilities related to the environmental <br /> management of the Site under local, State, and Federal law. Finally, many <br /> sources of contamination are identified by a typical SSCR. Although the San <br /> Joaquin County Environmental Health Department may not require a response to <br /> all conditions identified, Live Oak recommends that the client thoroughly consider <br /> all identified conditions and seek further information if desired. <br /> LOGE 20-28 7 <br />
