He is willing to
acknowledge and sign a form of understanding about it all, but he will not sign that he is agreeing to comply with the
permit itself as he has nothing to do with our business other than being an absentee landlord with hired on site security.
I am sure that there isn't a problem that they would agree to clean up the area if we just up and left our stuff there and
went out of business or something-they're just not going to sign that they're going to comply with our permit. We're
not sure how to alleviate that unless they can sign a separate statement or something.
Kevin
From: Robert McClellon [EH] [RMcClellon@sjcehd.com]
Sent: Monday,April 22, 2013 8:34 AM
To: Benjamin Escotto [EH]; Kevin Clutter
Subject: RE:Transfer Station Inspection
Kevin, the Notification Tier is a tier where you notify the EHD that you are operating, as long as you meet the criteria,
then you can operate.
The permit you are referencing is a permit that the EHD issues. The EHD is allowed to recover costs for the
implementation of the program. The permit is a mechanism that is used to do that. Because you do not meet the criteria
for a Notification Tier you are required to make application for the Registration Tier. The Registration Tier is more
complex. You will need to be added to the County Wide Integrated Management Plan under the Non Disposal Facility
Element prior to issuing the Registration Permit. We talked about ways around the tonnage by separating waste stream,
but you indicated that would not work here. If you have any questions please let me know. Robert
Robert McClellon, Program Coordinator RENS
Environmental Health Department
1868 E.
