The Site Approval is valid for 18 months and is subject to completion of the COAs, <br /> including building permits within that time period. The expiration date is June 4, 2022. <br /> An extension is required as certain COAs, including building permits are still pending. <br /> The status of two of the incomplete Conditions or agency approvals <br /> In addition to the Time Extension, a further discussion with the County to facilitate the timely <br /> issuance <br /> of the construction permits is needed as the cost for delayed permits is significant. One of the <br /> specific COAs which needs clarification and where the County can facilitate completion of the <br /> project is listed on Page 2. A meeting with IAA to discuss other actions and strategies will be <br /> initiated by Ed Bark. <br /> Reasons for Extension: <br /> 1.) Department of Public Works Condition No. 12 requires the construction of the widening <br /> of Cherokee Road or the execution by the owner of a Deferred Frontage and Roadway <br /> Improvement Agreement. The Agreement, to be prepared by the County, has not yet been <br /> forwarded to the owner for review. Scott Cooper of the Dept of Public Works has been in regular <br /> contact and his last communication on April 26, 2022, indicated that draft Agreement was still in <br /> review by County senior public works staff. The Agreement will require review an approval by <br /> the Owner's engineers and legal counsel in advance of execution.It is unlikely this can be <br /> completed before June 4`h, 2022. <br /> ------ -2-)--Building-Plan-review-was-stalled as-a result-of a-disagreement-between-the Owner-and------ --- <br /> County representatives as to the floodplain requirements of the COX As a result of discussions <br /> with the County Public Works department representatives an application to FEMA for a <br /> CLOMR-F was submitted and this review process by FEMA is not yet complete. FEMA has <br /> been slow to process and approve the application. <br /> 3) Requested Clarification COA to Facilitate Construction. Department of Public Works <br /> Condition No. 10 requires that the construction of the Newton Road frontage improvements be <br /> completed (using the Encroachment Permit process) before a building permit can be issued. It <br /> was discussed with senior Public Works representatives that no Certificate of Occupancy would <br /> be granted until the Newton Road improvements were done. County staff has verbally stated that <br /> the "building permit" in question is typically for the structures only, and not site work. The <br /> owner/developer would like to hire one contractor and have the ability to perform all elements of <br />
