Three 7.98 fl oz. bottles of Matte Varnish (item#1825439)were observed in a Flammable Hazardous Waste <br /> container. Carol Arredondo,Assistant Store Manager, and Fatima Kascht, Sr.Assistant Store Manager, could not <br /> readily explain how the Matte Varnish was determined to be flammable. Later during the inspection Fatima had <br /> Cynthia Lopez,Assistant Store Manager, login to Hobby Lobby's online portal, to find a Safety Data Sheet(SDS)for <br /> the Matte Varnish. Cynthia provided a copy of the SDS,which states that the Matte Varnish is noncombustible, <br /> indicating that the material is nonflammable. Cynthia stated that if she would have had to place the Matte Varnish in <br /> one of the on-site hazardous waste containers, she would have also placed it in the Flammable Hazardous Waste <br /> container since the Matte Varnish is a liquid. <br /> 2.A 4 fl oz. bottle of GelRite Instant Hand Sanitizer expired September 2020 was observed on a shelf in the <br /> hazardous waste storage area. Fatima could not determine which hazardous waste container the hand sanitizer <br /> should be placed in.A SDS for the hand sanitizer could not be found at the time of inspection. <br /> REGULATION GUIDANCE:A business operator shall keep records of any hazardous waste determinations made <br /> in accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the <br /> date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may <br /> include Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the Matte Varnish and <br /> GelRite Instant Hand Sanitizer waste, maintain on site and submit a copy to the San Joaquin County Environmental <br /> Health Department(EHD). <br /> If hazardous waste determination documentation is not available, immediately make a hazardous waste <br /> determination and begin managing the Matte Varnish and GelRite Instant Hand Sanitizer as specified in Title 22 <br /> CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your <br /> hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including <br /> sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste <br /> determination. <br /> Demonstrate current storage and labeling for wastes determined to be hazardous wastes.
