A J OA U I Environmental Health Department <br /> COUNTY <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> GARDELLA FARMS 3003 N DUNCAN RD, LINDEN October 08, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br /> OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented)that <br /> employees who handle hazardous waste were properly trained. Mr. Gardella indicated that he and his one <br /> employee are the onces handing hazardous wastes onsite. Mr. Gardella appeared to be unfamiliar with some <br /> general hazardous waste handling requirements. <br /> REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper <br /> waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and <br /> emergencies. <br /> CORRECTIVE ACTION: Immediately train all facility employees, as required. Provide proof of training within 30 <br /> days to the San Joaquin County Environmental Health Department(EHD)for employees whose responsibilities <br /> include hazardous waste. <br /> This is a minor violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. Mr. Gardella indicated that when he disposes of his waste oil he is not being provided <br /> with a receipt. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Begin the practice of maintaining all copies of disposal records for the past three years for <br /> all hazardous waste including (used/waste oil, used oil filters, used absorbents (spill clean up), etc..
