The site owner did not want to <br /> provide the keys at this time and requested the LEA to contact Jay Kamine of URS to <br /> arrange any access to the site. <br /> XVI. On May 70h,2004,this LEA sent a written notice to Tandy Corporation requiring <br /> quarterly gas monitoring of the newly constructed monitoring wells for gas migration. <br /> The monitoring was to be performed within 30 days,and the results of the monitoring <br /> were to be submitted within 90 days. (Exhibit D) <br /> XVII. On May 25,2004,this LEA received a letter from Jay Kamine of URS regarding a <br /> resolution of subsequent quarterly monitoring period. The purpose of the letter was <br /> to clarify the date on which quarterly gas monitoring of the monitoring wells would <br /> be completed. This LEA informed Jay Kamine of URS that it would be acceptable to <br /> complete the quarterly gas monitoring activities in July 2004. <br /> XVIII. On July 8th, 2004,this LEA conducted an annual routine inspection of the site and <br /> performed gas monitoring of the four monitoring wells for gas migration. The results <br /> from the monitoring indicated a methane gas concentration of 19.7%on gas well#4 <br /> (VW-4)located on the north property boundary. It was documented on the inspection <br /> report that the gas concentration of methane in monitoring well VW-4 was in <br /> violation of section 20919 of Title 27 California Code of Regulations (27 CCR), Gas <br /> Control, exceeding the lower explosive limit(5%methane by volume). It was also <br /> documented on the inspection report that adequate gas control measures must be <br /> provided and a remediation plan must be submitted within 60 days. (Exhibit E) <br /> XIX. On July 13th, 2004,this LEA sent a written notice to Tandy Corporation requiring a <br /> remediation plan to be submitted within 60 days for the methane gas releases at the <br /> site. (Exhibit F) <br /> XX. On August 17th, 2004,this LEA received a quarterly gas monitoring report from <br /> URS. The results indicated that monitoring wells VW-1,VW-2, and VW-3 were 0% <br /> for methane. The report also indicated that the methane concentration in monitoring <br /> well VW-4 was at 18.9%. <br /> XXI. On August 25th, 2004,this LEA forwarded the quarterly gas monitoring report to <br /> John Macanas of California Integrated Waste Management Board(CIWMB), <br /> Permitting and Enforcement Division. (Exhibit G) <br /> XXII. On September 9th, 2004,this LEA submitted an updated Site Identification Form <br /> (SIP)to John Macanas of CIWMB,Permitting and Enforcement Division. The <br /> purpose of the SIP was to increase the inspection frequency from annually to <br /> quarterly due to landfill gas migration concerns at the site. (Exhibit H) <br /> XXIII.
