Phase I Environmental Site Assessment <br /> Neighborhood E <br /> Page 7 <br /> Bethany Irrigation District (BBID) has an easement for the right of ingress and egress, pole lines, and to <br /> construct, operate, and maintain pipelines and/or drainage conduits, as well as conveying and diverting <br /> drainage of water. The BBID and the West Side Irrigation District have a right-of-way for drainage rights. <br /> The Valley Pipe Line Company owns an easement for pipelines and pole lines. Additionally, there are <br /> several "facts" that are listed within the Preliminary Title Reports. One fact states that a Pacific Bell <br /> underground cable runs along the east-west road without an easement. Condor has no knowledge of <br /> whether or not these easements and facts (and any others contained within the Preliminary Title Report) <br /> affect the Site portions of the properties. A copy of the Preliminary Title Report is in Appendix F. <br /> 3.2 ENVIRONMENTAL LIENS OR ACTIVITY AND USE LIMITATIONS <br /> An environmental lien is a charge, security, or encumbrance upon title to a property to secure the payment <br /> of a cost, damage, debt, obligation, or duty arising out of response actions, cleanup, or other remediation <br /> of hazardous substances or petroleum products upon a property. There are no environmental liens placed <br /> on the property according to the Preliminary Title Report from Commonwealth Land Title Company. <br /> 3.3 SPECIALIZED KNOWLEDGE <br /> No specialized knowledge regarding the Site or surrounding area was used in this assessment. <br /> 3.4 VALUATION REDUCTION FOR ENVIRONMENTAL ISSUES <br /> No valuation reduction for environmental issues was revealed by the property owner or Site manager. <br /> 3.5 OWNER,PROPERTY MANAGER,AND OCCUPANT INFORMATION <br /> 1 Trimark Communities is the current proper y io ncr.
