Schulte Road Logistics Center 4.1-16 <br />the SJVAPCD adopted its SB 656 Particulate Matter Control Measure Implementation Schedule. The SJVAPCD <br />analysis of the CARB list concluded that all but one of the measures that apply to SJVAPCD sources had been <br />implemented or were in one of the SJVAPCD’s attainment plans for adoption within the next 2 years. The remaining <br />measure pertains to a future amendment of a rule for gasoline transfer into stationary storage containers, delivery <br />vessels, and bulk plants. <br />Applicable Rules <br />The SJVAPCD’s primary means of implementing air quality plans is by adopting and enforcing rules and regulations. <br />Stationary sources within the jurisdiction are regulated by the SJVAPCD’s permit authority over such sources and <br />through its review and planning activities. Unlike stationary source projects, which encompass very spec ific types <br />of equipment, process parameters, throughputs, and controls, air emissions sources from land use development <br />projects are mainly mobile sources (traffic) and area sources (small dispersed stationary and other non -mobile <br />sources), including exempt (i.e., no permit required) sources such as consumer products, landscaping equipment, <br />furnaces, and water heaters. Mixed-use land development projects may include nonexempt sources, including <br />devices such as small to large boilers, stationary internal com bustion engines, gas stations, and asphalt batch <br />plants. Notwithstanding nonexempt stationary sources, which would be permitted on a case-by-case basis, SJVAPCD <br />Regulations VIII and IX generally apply to land use development projects and are described below. <br />Regulation IV – Prohibitions <br />• Rule 4102: Nuisance – Prohibits discharge of air contaminants or other materials from any source which <br />causes injury, detriment, nuisance, or annoyance to any considerable number of persons or to the public <br />or which endanger the comfort, repose, health, or safety of any such person or the public or which cause <br />or have a natural tendency to cause injury or damage to business or property. <br />• Rule 4601: Architectural Coatings – The purpose of the rule is to limit VOC emissions from architectural <br />coatings. This rule specifies architectural coatings storage, cleanup, and labeling requirements. <br />• Rule 4641: Cutback, Slow Cure, and Emulsified Asphalt, Paving and Maintenance Operations – The <br />purpose of this rule is to limit VOC emissions by restricting the application and manufacturing of certain <br />types of asphalt for paving and maintenance operations. <br />Regulation VIII – Fugitive PM10 Prohibition <br />• Rule 8021: Construction, Demolition, Excavation, Extraction, and Other Earthmoving Activities – The <br />purpose of this rule is to limit fugitive dust emissions from construction, demolition, excavation, extraction, <br />and other earthmoving activities. The rule outlines Dust Control Plan requirements for certain applicable <br />construction activities. <br />• Rule 8031: Bulk Materials – The purpose of the rule is to limit fugitive dust emissions from the outdoor <br />handling, storage, and transport of bulk materials. <br />• Rule 8041: Carryout and Trackout – The purpose of this rule is to prevent or limit fugitive dust emission s <br />from carryout and trackout. <br />• Rule 8051: Open Areas – The purpose of this rule is to limit fugitive dust emissions from open areas. <br />• Rule 8061: Paved and Unpaved Roads – The purpose of this rule is to limit fugitive dust emissions from <br />paved and unpaved roads by implementing control measures and design criteria. <br />• Rule 8071: Unpaved Vehicle/Equipment Traffic Areas – The purpose of this rule is to limit fugitive dust <br />emissions from unpaved vehicle and equipment traffic areas.
