Applicable Greenhouse Gas–Related Laws and Regulations <br />Project Component <br />Applicable Laws/ <br />Regulations Greenhouse Gas Reduction Measures Required for Project <br />EO B-37-16 Water use associated with the Project will be subject to <br />Emergency EO B-37-16, issued May 9, 2016, which directed the <br />State Water Resources Control Board to adjust emergency water <br />conservation regulations through the end of January 2017 to <br />reflect differing water supply conditions across the state. The <br />Water Board also developed a proposal to achieve a mandatory <br />reduction of potable urban water usage that builds off the <br />mandatory 25% reduction called for in EO B-29-15. The Water <br />Board and Department of Water Resources will develop new, <br />permanent water use targets to which the Project will be subject. <br />The Water Board will permanently prohibit water-wasting <br />practices, such as hosing off sidewalks, driveways, and other <br />hardscapes; washing automobiles with hoses not equipped with <br />a shut-off nozzle; using non-recirculated water in a fountain or <br />other decorative water feature; watering lawns in a manner that <br />causes runoff, or within 48 hours after measurable precipitation; <br />and irrigating ornamental turf on public street medians. <br />EO B-40-17 EO B-40-17 lifted the drought emergency in all California <br />counties except Fresno, Kings, Tulare, and Tuolumne. It also <br />rescinds EO B-29-15, but expressly states that EO B-37-16 <br />remains in effect and directs the State Water Resources Control <br />Board to continue development of permanent prohibitions on <br />wasteful water use to which the Project will be subject. <br />SB X7-7 Water provided to the Project will be affected by SB X7-7’s <br />requirements for water suppliers. SB X7-7, or the Water <br />Conservation Act of 2009, requires all water suppliers to <br />increase water use efficiency. It also requires, among other <br />things, that the Department of Water Resources, in consultation <br />with other state agencies, develop a single standardized water <br />use reporting form, which would be used by both urban and <br />agricultural water agencies. <br />CALGreen Code The Project is subject to CALGreen’s water efficiency standards, <br />including a required 20% mandatory reduction in indoor water <br />use (CALGreen Code, Division 4.3). <br />California Water <br />Code, Division 6, <br />Part 2.10, <br />Sections 10910– <br />10915. <br />Development and approval of the Project requires the <br />development of a Project-specific Water Supply Assessment. <br />Cap-and-Trade <br />Program <br />The Project proposes utilization of a private well for water and an <br />on-site septic system for sewage disposal.
