5 – Effects Found Not To Be Significant <br />Draft Environmental Impact Report February 2021 <br />14800 W. Schulte Road Logistics Center 5-9 <br />Hazardous Materials Site Complied Pursuant to Government Code Section 65962.5 <br />The Hazardous Waste and Substances Sites List (Cortese List) is a planning document providing information about <br />the location of hazardous materials release sites. California Government Code Section 65962.5 requires the <br />California Environmental Protection Agency to develop, at least annually, an updated Cortese List. The Department <br />of Toxic Substances Control is responsible for a portion of the information contained in the Cortese List. Other state <br />and local government agencies are required to provide additional hazardous materials release information for the <br />Cortese List. <br />A review of federal, state, County, and city environmental record sources, conducted as part of a Phase I <br />Environmental Site Assessment (Partner 2018a), identified the Project site on several regulatory da tabases <br />for the use and storage of hazardous materials . However, subsequent investigation that was conducted as <br />part of the Phase I Environmental Site Assessment and the Phase II subsurface investigation concluded that <br />the Project’s listing on these regula tory databases would not pose a health risk to future occupants of the <br />Project site (Partner 2018a, 2018b). Therefore, impacts associated with Cortese List hazardous materials sites <br />would be less than significant. <br />Airport-Related Safety Hazards or Excessive Noise <br />The Project is not located within the vicinity of a private airstrip or an airport land use plan or, where such a plan <br />has not been adopted, within 2 miles of a public airport or public use airport. The closest airport is the Tracy <br />Municipal Airport, located approximately 3 miles southeast of the Project site, and the Project site is outside of the <br />airport influence area as delineated in the Tracy Municipal Airport Master Plan (City of Tracy 1998). As such, no <br />impacts associated with public or private airstrips would occur. <br />Emergency Response and Evacuation Plans <br />The County of San Joaquin Emergency Operations Plan is an all-hazards document describing the County’s incident <br />management structure, compliance with relevant legal statutes, other relevant guidelines, whole community <br />engagement, continuity of government focus, and critical components of the incident management structure. <br />According to the Emergency Operations Plan, major transportation routes in the County, including I-580 and I-205, <br />would be possible evacuation routes in the event of an emergency (County of San Joaquin 2019b). <br />The Project would not affect these routes, and moreover, the Project would not affect the County’s ability to <br />implement its Emergency Operations Plan in the event of an emergency. In addition, the City of Tracy has adopted <br />a Comprehensive Emergency Management Plan (City of Tracy 2020). However, there are no specific routes <br />identified in the Comprehensive Emergency Management Plan. Notwithstanding, the Project would not impede <br />access to any public route that might be needed as an evacuation route. Should Project construction require <br />temporary closures of lanes within Schulte Road, traffic control measures (consistent with the California Manual on <br />Uniform Traffic Control Devices and as required by the County Public Works Department as part of the <br />encroachment permit process) would be implemented to ensure local emergency access is maintained. As a result, <br />the Project would not significantly affect emergency response or evac uation activities. Therefore, impacts <br />associated with emergency response or evacuation plans would be less than significant.
