di <br /> Memorandum <br /> To: Donna Heran,REHS,Director <br /> cc: Al Olsen, RENS,Program Manager <br /> From: Robert McClellon, Supervising REHS <br /> Date: June 6, 2003 <br /> Subject: Roos Ranches,Inc.,938 Frontage Road,Ripon <br /> In February 2003,the San Joaquin County Department of Public Works-Solid Waste <br /> Division(DPW)referred a complaint to the Environmental Health Department(EHD) for <br /> enforcement, alleging that Jeff Stuit, General Manager of Roos Ranches was conducting an <br /> illegal waste hauling operation without a DPW solid waste collection license. The <br /> requirements for a commercial and industrial solid waste collection license are found in San <br /> Joaquin County Ordinance Code, Chapter 2, Section 5-2202. The Ordinance requires that a <br /> proposed hauler apply in writing to the Director of Public Works for application review and <br /> completeness. The Ordinance Code further requires that the application be transmitted to <br /> the Environmental Health Department for review and recommendation based on the <br /> applicant's ability to comply with County Ordinance and State law. Thereafter,the <br /> Director of Public Works submits the application for Board of Supervisors'review and <br /> possible issuance of the collection license. <br /> The individual who filed the Roos Ranches complaint is a registered hauler that conducts <br /> business in the Manteca—Ripon area. He felt that Roos Ranches should be made to <br /> comply, as he does,with the San Joaquin County Ordinance Code that requires haulers of <br /> commercial solid waste to obtain a collection license and be subject to inspection. Solid <br /> waste is a highly regulated and fiercely competitive business. <br /> On March 18,2003, I made contact with Jeff Stuit of Roos Ranches and met with him at his <br /> place of business. I spoke with him regarding the requirements for solid waste haulers and <br /> left him a copy of the county ordinance requirements. <br /> I spoke with Jaime Perez, Interim Integrated Waste Manager of DPW,and informed him. <br /> that the EHD would be sending Roos Ranches a compliance letter. On April 1,2003,the <br /> letter was mailed and directed Roos Ranches to discontinue the collection and transportation <br /> of solid waste and make application to DPW for a collector's license in accordance with San <br /> Joaquin County Ordinance Code, Chapter 2, Section 5-2202 (b). <br />
